City staff has been advised by tne City Attorney thatr <br />according to city ordinance, fees cannot be refunded after the <br />matter has been referred to thr. Planning Commission without action <br />of the C~ty C;mnciL The City J\ttorney further advises that the <br />City Counci~ should not refund t.e fees after the matter has been <br />referred unless it has been deterrnlned that the costs incurred by <br />the City are substantially less than the fees pald. The amount <br />refunded should only be the amount of the fees paid which exceeds <br />City costs. <br /> <br />COUNCIL ACTION REQUESTED: Motlcn to approve the acceptance of <br />B~lair Builder's request for rezoning <br />from I-I to 1-2, speclal use pe~mit5 for <br />a planned unit development, ~ruck rental <br />agency and commercial truck wash, and <br />variances to parking setback, curbing, <br />and fence height requirements at 2211 <br />County Road C-2. <br />
