City staff has been advised by the City Attorney that, according <br />to city ordinance, fees cannot be refunded after the matter has been <br />referred to the pldnning commission wlthout action of the city Council. <br /> <br />Th6 City Attorney further advise~ that the City Cou~ci~ should not <br />refund fees after the matter has been referred unless it has been <br />determined that the costs lncurred by the C1ty are substantially less <br />than the fees paid. The amount re1unded should only he the amount of <br />the fees paid which exceeus City costs. <br /> <br />The staff has determlned that the 3ssociated staff costs have exceeded <br />the original fces. <br /> <br />COUNCIL ACTION REQUESTED: <br /> <br />Motion to apptove the acceptance of Belair BU11dersr reques~ to with- <br />draw from 1-1 to 1-2, Special Use Permits for a Pl~nned unit Develop- <br />ment, truck rental agency and commercial truck wash, and variances to <br />parking setback, curbing, and fence h&ight requiremepts at 2211 County <br />Road C-2. <br /> <br />. <br />--- <br />
