Belair Builders' has requested a refund of its $1,650.00 application fee. City staff has been advised by the City Attorney that, according to city ordinance, fees cannot be refunded after the matter has been referred to the pldnning commission wlthout action of the city Council. Th6 City Attorney further advise~ that the City Cou~ci~ should not refund fees after the matter has been referred unless it has been determined that the costs lncurred by the C1ty are substantially less than the fees paid. The amount re1unded should only he the amount of the fees paid which exceeus City costs. The staff has determlned that the 3ssociated staff costs have exceeded the original fces.
