<br />5.3 Staff analysis of undue hardship factors is as follows: <br /> <br />A. The property in question cannot be put to a reasonable use if used under <br />conditions allowed by the official controls: A business should be allowed some <br />type of signage acknowledging their location. The B-Dale Club has had a pre- <br />existing non-conforming sign for many years, for which the need to replace the <br />sign was created by an accident on the site. Requiring strict compliance with the <br />30 foot required setback would place the sign down the slope at a location <br />virtually impossible to see. The Community Development Staff has <br />determined that the property cannot be put to a reasonable use under the <br />official controls. <br /> <br />B. The plight of the landowner is due to circumstances unique to the property not <br />created by the landowner: Although the B-Dale Club sign was non-conforming <br />it directed patrons of both the Club and City ball fields on to the site. Existing <br />trees and the grade of the parcel hamper placement of a new sign in conformance <br />with Section 1005.0lAI. The Community Development Staff has determined <br />that the plight of the landowner is due to circumstances unique to the <br />property not created by the landowner. <br /> <br />C. The variance, ifgranted, will not alter the essential character of the locality: <br />The new sign, being placed at the property line, will be outside the public right- <br />of-way for the first time in many years. The sign is also tastefully designed and <br />of a residential scale. The Community Development Staff has determined that <br />this variance, if granted, will not alter the essential character of the locality. <br />nor adversely affect the public health, safety, or general welfare, of the city <br />or adjacent properties. <br /> <br />6.0 STAFF RECOMMENDATION: <br /> <br />6.1 Based on the information provided and the findings in Section 5 of this project report, the <br />Community Development Department recommends approval of the request by the B- <br />Dale Club in association with the Roseville Park and Recreation Department for a 30 foot <br />variance to Section 1005.0lAl of the Roseville City Code for property at 2100 Dale <br />Street, subject to the following conditions: <br /> <br />a. The verification of the property line adjacent to Dale Street. <br /> <br />b. The sign not encroaching closer that the 29 foot variance or no closer than the one <br />foot to the property line adjacent Dale Street. <br /> <br />c. The review and approval of a building permit consistent with the approved <br />variance and plans. <br /> <br />d.
