<br />4.0 BACKGROUND <br /> <br />4.1 Section 1012.09A states: the City Council may authorize an interim use permit of <br />property. Interim use may not be consistent with the land uses designated on the adopted <br />Land Use Plan. They may also fail to meet all of the zoning standards established for the <br />district within which it is located. <br /> <br />4.2 Section 1012.09B states: the City Council may attach conditions to interim use permits. <br />In reviewing interim use permit applications, the City will establish a specific date or <br />event that will terminate the use on the property. The Council will also determine that <br />the approval of the interim use would not result in adverse effects on the public health, <br />safety and general welfare, and that it will not impose additional costs on the public if it <br />is necessary for the public to take the property in the future. <br /> <br />4.3 Section 1007.02Dll allows motor vehicle dealers as a conditional use permit, while <br />Section 1007.02B prohibits open storage in the Light Industrial District and requires all <br />storage to be within an enclosed building. Staff has long interpreted these two Sections <br />of the Roseville City Code to allow open storage when affiliated with a motor vehicle <br />dealer and with an approved conditional use permit, but has not allowed open storage of <br />vehicles within a non-dealership parking lot. <br /> <br />4.4 Previous to this application, Wally McCarthy had entered into a lease agreement with the <br />Salvation Army to lease the western portion of the parking lot with access onto County <br />Road B-2 to store vehicle inventory. However, the City determined that this use was in <br />violation of the City Code and asked Wally McCarthy Auto Group to cease and desist or <br />apply and receive an interim use permit. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 The Salvation Army has indicated a willingness to allow the storage of vehicles on the <br />western )11ost lot, but with a limitation of June 10,2003, to correspond with the <br />e-~~t~ date of their lease with Wally McCarthy Auto Group. <br /> <br />5.2 The current/proposed parking of vehicles on the western most lot has resulted in lost <br />parking spaces; however, the use of the property as temporary vehicle inventory storage <br />will have no impact on parking needs of the Salvation Army and/or their tenant. <br /> <br />5.3 The proposed interim use of the property for temporary vehicle inventory storage will not <br />have an adverse impact on the market value of contiguous properties. <br /> <br />5.4 The proposed interim use of the property for temporary vehicle inventory storage will not <br />have an impact on parks, streets and other public facilities. <br /> <br />5.5 The proposed interim use of the property for temporary vehicle inventory storage will not <br />have an adverse impact on the general public health, safety and welfare. <br /> <br />PF3412 - ReA 072902 - Page 2 of 4 <br />
