WHEREAS, the City of Roseville acquired fee simple title to certain real property
<br /> located in Roseville, Minnesota, shown and described as "Proposed Vacation Area" in Exhibit A
<br /> attached hereto, which Proposed Vacation Area was acquired with other real property on which
<br /> • portions of Twin Lakes Parkway and Mount Ridge Road have been constructed; and
<br /> WHEREAS, a majority of the property owners abutting the Proposed Vacation Area have
<br /> filed a Petition with the City of Roseville requesting the vacation of all existing roadway and
<br /> highway easements on, over and across said real property; and
<br /> WHEREAS, after two weeks published and posted notice having been given, as well as
<br /> notice having been mailed to all affected property owners according to Minnesota Statutes and
<br /> Roseville City Code, a public hearing was held by the Roseville Planning Commission on
<br /> September 5, 2012 at which all persons interested in said Petition were given an opportunity to
<br /> be heard prior to a unanimous vote by the Planning Commission to approve said vacation; and
<br /> WHEREAS, the Roseville City Council has determined that it is in the best interest of the
<br /> City to approve such Petitions;
<br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
<br /> OF ROSEVILLE, MINNESOTA:
<br /> 1. That the City of Roseville hereby vacates that portion of the public roadway and
<br /> highway easement created by said Document No. 1511814 referred to above lying on, across and
<br /> over that real property located in the City of Roseville which is legally described as follows:
<br /> That part of the east 10.00 feet of Lots 6,7,8,9 and 10, Block B, TWIN VIEW,
<br /> according to said plat on file and of record in the office of the County Recorder,
<br /> Ramsey County, Minnesota, as described in Quit Claim Deed, Document Number
<br /> 1511814, recorded June 7, 1960, which lies southerly of a line drawn parallel with
<br /> and distant 168.18 feet northerly of the southerly line of said Lot 7, Block B,
<br /> AND
<br /> That part of the west 10.00 feet of Lots 2, 3, 4, and 5, Block C, TWIN VIEW,
<br /> according to said plat on file and of record in the office of the County Recorder,
<br /> Ramsey County, Minnesota, as described in Quit Claim Deed, Document Number
<br /> 1511814, recorded June 7, 1960,which lies southerly of the easterly extension of
<br /> a line drawn parallel with and distant 65.50 feet northerly of the southerly line of
<br /> Lot 7, Block B of said TWIN VIEW,
<br /> 2. That the City of Roseville hereby vacates all existing public roadway and highway
<br /> easements on, over and across that real property located in the City of Roseville which is shown
<br /> and described as Proposed Vacation Area in Exhibit A attached hereto.
<br /> 3. The City is vacating only the easements described herein, and not any other easements
<br /> or rights in the real property described in Provisions 1 and 2 above.
