<br />Page 4 <br />Contractor may begin staging collection equipment after 2:00 p.m. Friday afternoon immediately <br />preceding the Clean Up Day. However, the City will not be liable for any damage that may occur <br />to the equipment left overnight at the site. All collection equipment shall be removed by 5:00 <br />p.m. on the Clean Up Day. <br />3.08. Cleanup Responsibilities <br />Contractor shall adequately clean up any materials spilled, leaked or blown during the course of <br />collection and/or hauling operations and return the area to the state that existed prior to set up. <br />3.09. Severe Weather <br /> <br />20 degrees F or colder. The Contractor will be responsible for notifying the residents by radio <br />and/or television announcements. The City will be responsible for notifying the residents by <br />on <br />postponement, the City shall select an alternate date for the Clean Up Day. <br />3.10. Weighing of Loads <br />Contractor will keep accurate records regarding the date and time of delivery of material to the <br />Resource Recovery Facility or other designated facility, and the weight or number of items <br />delivered to the facility. The information shall be maintained on file by the contractor for at least <br />three years from the date of the Clean Up Day in the event of an audit by the City or County. <br />3.11. Utilities <br /> The Contractor shall be obligated to protect all public and private utilities whether occupying <br />operations, he/she shall repair or replace same, or failing to do so within 48 hours, the City shall <br />cause repairs or replacement to be made and the cost of doing so (including administrative <br />charges) shall be charged to the Contractor. The Contractor shall reimburse the City for any such <br />expenses within 10 days of receipt <br />3.12. Damage To Property <br />The Contractor shall take all necessary precautions to protect public and private property during <br />the performance of this Agreement. The Contractor shall repair or replace any private or public <br />property, including, but not limited to sod, mailboxes, or vehicles, which are damaged by the <br />Contractor. Such property damage shall be addressed for repair or replacement, at no charge to <br />the property owner, within forty-eight (48) hours with property of the same or equivalent value at <br />the time of the damage. <br />If the Contractor fails to address the repair or replacement damaged property within 48 hours, <br />shall cause repairs or replacement to be made and the cost of doing so (including administrative <br />charges) shall be charged to the Contractor.
