<br />(c) Changes. A change to the Concept Plan or Construction Plans following approval <br />by the City need not be resubmitted to the City unless such change would increase or decrease <br />the square footage of the Minimum Improvements for the Concept Plan or Construction Plans <br />under consideration, together with the square footage of all previously approved Concept Plans <br />or Construction Plans, by ten percent (100/0) or more. <br /> <br />Other than as set forth above, if the Redeveloper desires to make any material change in the <br />Concept Plan or Construction Plans after approval thereof by the City, then the Redeveloper shall <br />submit the proposed change to the City for its approval. The City shall approve or reject (in <br />whole or in part) such change in writing within thirty (30) days after the date of receipt thereof. <br />If the Concept Plan or Construction Plans, as modified by the proposed change, conform(s) to the <br />requirements of this Section with respect to such previously approved Concept Plan or <br />Construction Plans, the City shall approve the proposed change and notify the Redeveloper in <br />writing of its approval. <br /> <br />Section 5.7. Project Phasing. <br /> <br />(a) <br /> <br />(1) <br /> <br />No certificate of occupancy will be issued for any of Blocks 4, 5 or 6 until: <br /> <br />(i) Twin Lakes Parkway has been constructed between Cleveland and <br />Fairview Avenues (subject to Section 5.1) and Prior Avenue has been constructed, <br /> <br />(ii) With respect to all of the Redevelopment Property in Blocks 1-6, <br />the Redeveloper has obtained title, performed demolition, clearance, environmental remediation <br />and soils correction, rough graded and completed all Public Improvements, <br /> <br />(iii) Model homes for at least two (2) different housing products have <br /> <br />been completed, <br /> <br />(iv) Framing has been substantially completed for at least 80 housing <br /> <br />units, and <br /> <br />(v) Building permits have been issued for an additional 120 housing <br /> <br />units. <br /> <br />(2) Prior Avenue shall be constructed in conjunction with the construction of <br />Blocks 2 and 4. Subject to Unavoidable Delays, Public and Site Improvements for Blocks 2 and <br />4 will begin within approximately 60 days after receipt of all final approvals, expiration of any <br />appeal period related to creation of the Tax Increment District or any eminent domain <br />proceeding, acquisition of all Parcels and issuance of building permits, and shall be completed <br />within 12 months thereafter. Construction of Minimum Improvements shall begin within 30 <br />days of completion of Public and Site Improvements. <br /> <br />(3) Commencement of Construction of Block 1 shall begin no later than three <br />(3) years after the date of execution of this Agreement.
