<br />Community Development Department <br />651-490-2279 . fax: 651-490-2931 <br /> <br />June 18, 2003 <br /> <br />Mr. Karl Dordal <br />Watkins Motor Lines, Inc. <br />Mr. Bill Elshotz <br />Western Resources <br />2560 Long Lake Road <br />Roseville, MN 55113 <br /> <br />RE: City Council action on 5-Year Interim Use Permit (PF3485) <br />Gentlemen: <br /> <br />This letter is to confirm that on June 16,2003, the Roseville City Council approved your request (by <br />adoption of a Resolution) for a five-year Interim Use Permit, allowing storage and use of the site at 2560 <br />Long Lake Road for seasonal and peak period trailer storage, subject to interim use standards for interim <br />use parking, which include a grading plan and proper drainage; packed, dustless gravel; fencing, <br />landscaping screening, ponding as needed and lighting. Specifically, the conditions of approval are as <br />follows: <br /> <br />1. {[the use is being operated by a person other than the current applicants (Watkins) for the <br />Interim Use Permit of the property, the permit shall require both the owner and the operator <br />to furnish the city with an agreement (or a copy of a lease containing such agreement) that: <br />a. the operator's right to possession of the premises for the purpose of conducting the <br />interim use is dependent upon the interim use permit having been granted and <br />maintained in full force and effect; and <br />b. the operator's right to possession of the premises for the purpose of conducting the <br />interim use will terminate upon any expiration or revocation of the interim use <br />permit; and <br />c. it shall be the responsibility of the owner to terminate the operator's possession of the <br />premises upon any expiration or revocation of the interim use permit if the operator <br />continues to utilize the premises for the conduct of such interim use. <br /> <br />2. Each permittee shall be jointly and severally liable for all costs and expenses, including <br />attorneys'fees, the city may incur to enforce the conditions of the interim use permit upon any <br />breach thereof by the permittee, or to abate and remove the interim use upon any failure by <br />the permittee to discontinue such use, or to evict the operator of such use, upon the expiration <br />or revocation of the interim use permit. <br /> <br />3. The applicant/property owner agrees to complete fire, life safety, and codes inspection of the <br />proposed use with the city fire and building inspectors. The applicant shall provide a scaled <br />property survey and development plan illustrating all property lines, buildings, paving, <br />ponding, grading, compacted gravel surfaces, fencing, lighting, landscaping and/or <br />screening, and setback dimensions.
