There is no vested right or legal entitlement to an extension and the decision on <br />any application for extension shall be within the sole discretion of the City Council. <br /> <br />13. The City Council shall, in all cases, retain continuing jurisdiction over each such permit and <br />may, at any time, either on its own initiative or in response to a violation of the terms of the <br />permit, modifY or delete any conditions of the permit or impose any new conditions if <br />necessaJY in order to preserve the public health, safety and welfare, or to prevent the <br />creation or continuance of a public nuisance, or where such action is necessary to preserve <br />or restore any of the findings set forth in this resolution. Prior to Council action on an <br />amendment to the permit, the Planning Commission shall conduct a public hearing on the <br />proposed modification to the permit conditions and notice thereofshall be given in the same <br />manner as prescribed in Section 108 and Section 1012. <br /> <br />14. Violations of the terms of this Interim Use Permit shall be considered grounds for revocation <br />of the Interim Use Permit at anyone time or grounds for denial of a permit extension to a <br />filrther five year period. An interim use permit may be revoked upon a determination by the <br />City Council that the holder of such permit has failed to comply with any of the conditions <br />thereof or has violated any applicable provision of the City Code. Prior to Council action, the <br />Planning Conzmission shall conduct a public hearing on the revocation and notice thereof <br />shall be given in the same manner as prescribed in Section 108 and 1012. <br /> <br />You will receive a final copy of the resolution upon execution/signage by the appropriate City officers. <br />Please review the conditions as listed above and within the draft resolution. The City will record a similar <br />copy of the resolution with Ramsey County.
