<br /> <br /> <br />9. Except for the truck and trailer parking and storage, no additional exterior <br />storage on the site shall be permitted. No additional commercial vehicles may <br />be parked or stored on the site. <br /> <br />10. Signage shall be non-lighted, non-flashing, non-moving, and shall not exceed <br />75 s.L <br /> <br />11. The interim use permit shall expire on June 16, 2008, unless an application is <br />submitted for a five year extension of the permit by March 1, 2008. Upon the <br />expiration date of the initial term of the interim use permit, as established by <br />the City Council, the permit shall automatically expire without action of any <br />kind unless the permit is extended in accordance with this Section and Section <br />12.. <br /> <br />12. Applications for extension shall be filed 120 days prior to the expiration date <br />of the original permit, or the expiration of any extension thereof. Unless the <br />original permit was expressly declared to be nonrenewable, the interim use <br />permit may be extended for additional terms of not more than five (5) years <br />each if the City Council makes all of the findings set forth in this resolution at <br />of the time of each renewal. The City Council shall be the approving authority <br />for any or all extensions of the permit. The Council may refer the application <br />for extension to the Planning Commission for study and recommendations <br />action thereon if the Council determines that special problems or <br />circumstances may exist with regard to the proposed extension. There is no <br />vested right or legal entitlement to an extension and the decision on any <br />application for extension shall be within the sole discretion ofthe City <br />Council. <br /> <br />13. The City Council shall, in all cases, retain continuing jurisdiction over each <br />such permit and may, at any time, either on its own initiative or in response to <br />a violation of the terms ofthe permit, modify or delete any conditions ofthe <br />permit or impose any new conditions if necessary in order to preserve the <br />public health, safety and welfare, or to prevent the creation or continuance of <br />a public nuisance, or where such action is necessary to preserve or restore any <br />of the findings set forth in this resolution. Prior to Council action on an <br />amendment to the permit, the Planning Commission shall conduct a public <br />hearing on the proposed modification to the permit conditions and notice <br />thereof shall be given in the same manner as prescribed in Section 108 and <br />Section 1012. <br /> <br />14. Violations of the terms of this Interim Use Permit shall be considered grounds <br />for revocation of the Interim Use Permit at anyone time or grounds for denial <br />of a permit extension to a further five year period.
