OF CITY OF SHOREVIEW ORDINANCE NO. 751 AN ORDINANCE ADOPTING A DEVELOPMENT MORATORIUM FOR PROPERTIES IN POLICY DEVELOPMENT AREA #11, THE HODGSON ROAD RESIDENTIAL AREA The Shoreview City Council ordains that 1.0 Recitals. A. The City of Shoreview ("City") is conducting studies and will schedule hearings for the purpose of considering amendments to Chapter 200, Development Regulations of the City's Municipal Code. B. Pending the completion of the planning studies and the adoption of amendments to its Development Regulations, the Shoreview City Council has determined that it will be in the public's interest to impose a development moratorium on the subdivision of land within Policy Development Area #11, the Hodgson Road Residential Area as identified in the 2000 Comprehensive Guide Plan. The term subdivision as used herein is the separation of an area, parcel or tract of land under single ownership into two or more parcels, tracts, lots or long term leasehold interests, except those separations specified in Chapter 462.358, Subd. 4 of Minnesota Statutes and any amendments thereto. C. Throughout the past several months, the City has received a number of inquiries from property owners and developers regarding the possible future redevelopment of this area. Development proposals have ranged from low-density single family residential to high density residential, including apartments. D. The City recognizes that the development or redevelopment of this area is challenging due to the number of property owners involved, adjacent land uses and access issues. The intent of the moratorium is to provide the City a reasonable period of time to review existing land use and development policies and pro actively plan for any future development in the area. During this time period, the City will facilitate a planning process to review land use objectives, work with existing property owners and receive input from the surrounding neighborhood. E. Construction activity within an existing structure, including exterior modifications and improvements will be permitted provided that such improvements are undertaken in compliance with the City's Comprehensive Guide Plan, Official Controls and Development Regulations.
