2.8 Should the request be approved by the City Council, the staff, prior to the applicant's
recording with the Ramsey County Recorder, must review a certificate of survey and a
quit claim deed for compliance with the Council's approval.

3.0 ST AFF FINDINGS & CONDITIONS:

3.1 In review of the Roseville City Code. the City Planner has concluded that the adjustment
in property line from its existing location to the proposed location falls under a
"RECOMBINATION" under Section 1104.04B and not a "THREE PARCEL MINOR
SUBDIVISION" as noticed to the public.

3.2 In February of2004 Mr. Albertson applied for a VARIANCE and MINOR
SUBDIVISION, seeking approval to create a substandard parcel width. On April 7, 2004
the Planning Commission held the public hearing requiring the request and unanimously
recommended denial, which action lead to the subsequent withdrawal of the request by
Mr. Albertson. During the Planning Commission's hearing, staff indicated to the
residents that should Mr. Albertson desire to divide the parcel in a manner that meets the
City Code, the process would be forwarded to the Council and the neighborhood would
be notified of the legal lot line adjustment.

3.3 The City Planner has concluded that the proposal meets the requirements of the
Comprehensive Plan and Zoning Ordinance.

3.4 The City Planner has concluded that the request meets the requirements of Section
1004.016 (Residential Dimensional Requirements), Section 1103.06Al and Section
11.0406F of the Roseville City Code. Specifically, both parcels have a minimum width
of 85 feet, a depth of 110 feet and a minimum of 11,000 sq. ft. Parcel "B" although
uniquely designed) has a minimum width of 85 feet at the established 30 foot front yard
setback. Parcel "B" has lot lines at substantial right angles to the street line.

3.5 The City policy is to accept park land or cash in lieu of land dedication for the creation of
new lots. However, Mr. Albertson is not creating a new lot, but rather adjusting the
existing line. No park land dedication is required for this change in lot design.

3.6 The City policy is to accept a Sewer Availability Charge (SAC) upon the issuance of a
building permit. In this case, a SAC fee is required and will be collected upon the
issuance of a building pern1it for Parcel B.

PF3556_RCA_051004 Page 2 of3
