I have the following comments: <br /> <br />. Section l004.0lE (Exception) reads: If, after May 2l, 1959, existing houses on 50% or <br />more of the frontage on any block have a predominant front yard setback different from <br />that herein specified, all buildings hereafter shall not be interpreted so as to require a <br />front yard of more than 40 feet in depth. <br /> <br />. Staff interprets the above code section in the following manner: Each home with a <br />greater front yard setback than the current 30 foot requirement is located at its <br />predominant setback. <br /> <br />. Your home was originally constructed in 1955 and lies approximate 45 feet from the <br />front (west) property line, thus required setback that the City can apply to your property <br />based on Section 1004.OlE is a 40 foot front yard setback. <br /> <br />. Section 1004.02D5 stipulates that your side yard setback must be a minimum of 5 feet <br />from the north property line. <br /> <br />. The City Code allows an attached garage without living space above to be placed 3 :-:-:~ <br />into the required front yard setback or in the case of your parcel an attached garage <br />without living space above could be constmcted 37 feet from the front property line. <br /> <br />. I have estimated that your garage lies lO feet from the north property line, which affords <br />you room for your propo:o.eJ dJJition. Should there be a greater distance separating the <br />garage from the side yard property line, such as the 12 feet you indicate on your drawing, <br />you would be able to widen your proposal as long as it does not encroach into the <br />required 5 foot setback. <br /> <br />2660 Civic Center Drive .:.
