<br /> <br />Agenda Section <br />CONSENT <br />A request by James Kuefferfora LOT LINE CORRECfION of his <br />property located at 890 Parker Avenue (PF3569) <br /> <br /> <br /> <br />Department Approval: <br />TP <br /> <br />Item Description: <br /> <br />1.0 REQUESTED ACfION <br /> <br />1.1 James Kueffer, 890 Parker Avenue seeks approval of a CORRECTION under the Minor <br />Subdivision requirements (Section l1004.04D) of the RoseviIle City Code to allow the <br />adjustment of an existing lot line between two parcels. Each parcel will meet or exceed <br />all City lot size requirements. <br /> <br />2.0 BACKGROUND: <br /> <br />2.1 Section 11 04.04D Correction, affords a property owner the ability to adjust a property <br />line that is found to be inadequate to describe the actual boundaries. This process does <br />not require a hearing. The Correction process requires only the review and approval of <br />the City Council. Upon approval of the City Council, the applicant is required to submit <br />a survey with the two new lot designs and legal descriptions, as well as the legal <br />documentation (quit claim deed or warranty deed) necessary for recording the corrected <br />parcels descriptions with Ramsey County. <br /> <br />2.2 Section l103.06A reads: the minimum lot dimensions in subdivisions designed for single <br />family detached dwelling developments shall be: (l) 85 feet wide at the established <br />building setback line and on outside curvatures. <br /> <br />2.3 In 2002, Mr. Kueffer received approval of a Minor Subdivisi~m that allowed him to create <br />an additional legal residential parcel. Since that date Mr. Kueffer has constructed two <br />new homes, one of each of the legal parcels. However, both lots share a driveway that <br />lies completely on the property at 896 Parker Avenue. <br /> <br />2.4 Mr. Kueffer has indicated an interest in shifting the lot line so that it lies as close to the <br />center of the shared driveway, within the width requirements of the City Code. The <br />shared drive has an easement over it and shared responsibility, which is better served by <br />having the property line divide, as best as possible, the driveway. <br /> <br />2.5 The proposal calls for Parcel "A" to have a width of 85.44 feet wide and Parcel "B to <br />have a width of 89.02 feet wide. The property line, as it extends through the parcel, <br />would be a minimum of 1 0 feet from either principal structure. <br /> <br />PF3569 _RCA_052404 Page 1 of2 <br />
