The property owner (Kissell) shall record the approved conditional use permit with the Ramsey County Recorder prior to the issuance of any building permit or within sixty days of approval, whichever is less (Section 1013.01-City Code). D. The conditional use permit shall expire within six months of the date of City Council approval if a building permit or a celiificate of occupancy is not obtained for the approved development (Section 1013.03 of the City Code). E. The applicant must be issued the appropriate license from the Mn. Department of Human Services within six months after the final approval of the conditional use permit. 8.0 PLANNING COMMISSION ACTION: 8.1 On June 2,2004, the Roseville Planning Commission held the public hearing regarding the Asempa conditional use permit request. At the hearing, no citizens were present to address the Commission. However, members of the Commission did ask questions of staff and the applicant. Specifically, the Commission was interested in knowing whether staff had a concern with the use and its proximity to the new bus tern1inal in Maplewood; what business currently occupy the building; and does the applicant anticipate taking walks to adjacent McCarrons park of on the near-by trails (see attached draft minutes). 8.2 The Commission voted (4-0) to recommend approval of the request by Akpene Asempa for a Conditional Use Permit to allow an adult day care at 1895 Rice Street, based on the findings in Section 6 and the conditions of Section 7 of the project report dated June 2, 2004. 9.0 SUGGESTED CITY COUNCIL ACTION: 9.1 ADOPT a RESOLUTION APPROVING a CONDITIONAL USE PERMIT allowing the operation of an adult day care facility for Akpene Asempa and property owner Jeffrey Kissell, located at 1895 Rice Street, based on the comments and findings outlined in Section 6 and conditions outlined in Section 7 of the project report dated June 14,2004.
