<br /> <br />not an if use <br />property exists under the terms of the ordinance....The board or governing as <br />the case may be may impose conditions in the granting of variances to insure <br />compliance and to protect". <br /> <br />5.10 The property in question cannot be put to a reasonable use if used under conditions <br />allowed bv the official controls: In light of the conclusion one can reach on "reasonable <br />use", the City Planner has concluded that a pylon sign 38 feet in height and including 254 <br />sq. ft. of sign area is permitted on the Rosedale Square property. However, this sign is <br />neither tall enough to be properly viewed from County Road C and Snelling Avenue or <br />large enough to afford all tenants equal signage critical to their business. The City has <br />worked with commercial property owners on matters related to unique signage challenges <br />in the past, granting similar approvals. The City Planner has determined that it is <br />reasonable to replace and relocate the existing pylon sign at Rosedale Square with a new <br />pylon sign that is tasteful and more in keeping with a monument sign; relocating the new <br />pylon sign near the intersection of Lincoln Drive and County Road C; construction two <br />new monument signs, each 14 feet in height which will afford all tenants varying degrees <br />of signage critical to their livelihood. The Staff has determined that the property can <br />be put to a reasonable use under the official controls if an AMENDED & <br />EXP ANDED VARIANCE to Section 1009 is granted. <br /> <br />5.11 The pli1rht of the landowner is due to circumstances unique to the property not <br />created bv the landowner: The Rosedale Square property is unique. To begin the <br />structure is an "L" shape with an estimated length north/south length of 1 ,080 feet and an <br />ease/west length of 380 feet, which structure becomes too difficult to view the entire <br />structure frontage from one single location. Next, pylon and monument signs are <br />constructed specifically to identify tenants within a commercial development to the <br />passing public. However, Rosedale Square's location, well back from Snelling Avenue <br />(major thoroughfare) and the structures design, limits the ability to appropriately identify <br />all tenants. Lastly, City Code changes in 1992 and 1993 limit the current property owner <br />to adequately provide critical signage for all tenants of Rosedale Square, except wall <br />(facade) signage, which cannot be viewed from Snelling Avenue, and portions of County <br />Road C and Lincoln Drive. The proposal seeks to relocate the pylon sign to a location <br />readily seen from Snelling Avenue and County Road C. The proposal further seeks to <br />construct two additional free-standing ground mounted (monument) signs 14 feet in <br />height and 72 sq. ft. in sign area signage that provide the customer with identification at <br />well seen vantage points along Lincoln Drive and County Road C.
