<br />651-792-7005 . fax: 651-792-7070 <br /> <br />November 8, 2004 <br /> <br />Ms Kathy Rothenberger <br />445 Turnstone Court <br />Roseville, MN 55113 <br /> <br />RE: Proposal to Construct a Deck on to Home. <br /> <br />Dear Ms. Rothenberger: <br /> <br />I have reviewed the City Code and other pertinent information regarding your parcel and have <br />the following comments regarding installing a deck on to your home at 445 Turnstone Court: <br /> <br />. Section 1016.05 defines a DECK as: "A horizontal, unenclosed platform with or <br />without attached railings, seats, trellises, or other features attached or functionally related <br />to a principal use or site and at any point extending more than three feet above ground". <br /> <br />. Section 1016.05 defines STRUCTURE as: "Any building or appurtenance, including <br />attached or detached decks and fences. "Structure" does not include aerial or <br />underground utility lines, such as sewer, electric, telephone, telegraph, gas lines, towers, <br />poles, seasonal docks, and other supporting facilities such as, at grade driveways and <br />patios" . <br /> <br />. Section 1016.16 (Structure Design Standards) requires all structures adjacent to a <br />Department of Natural Resources regulated water body or City public waters, to have a <br />minimum setback from the Ordinary High Watermark (OHW) of75 feet. <br /> <br />. A review of your parcel indicates an existing structure setback of approximately 47 feet <br />on the west side and approximately 70 feet on the east. Therefore, the proposed addition <br />of a six foot wide deck the length of the home would require a VARIANCE. <br /> <br />. Section 1012.02 (Required Yards and Open Space) requires decks to be set back a <br />minimum of two feet from a side yard property line. <br /> <br />. A further review of your parcel indicates that your home lies approximately 21 feet from <br />the west property line at the northern most point and approximately 6 feet from the west <br />property line along a majority of the southern portion of the home. The proposal to add a <br />large landing area may be difficult given the existing structure setbacks. <br />
