In return for the Transit Improvements, the City and Metro Transit are given the access rights on the bus routes and Transit facilities, upon written approval of the Mall. The City and Metro Transit are to cause the "least possible interference" with the operation the Mall. The Mall is responsible for insurance covering the transit facilities. Substantial fire damage to Rosedale and the Transit Hub may be a reason to terminate the existing agreement, with insurance proceeds given to the City. The Mall cannot relocate the Transit Hub waiting area and shelter but may, by notice to the Metro Transit, relocate the bus route at any time, permanently or temporarily. The Mall must either relocate all route signage or pay for the relocation. The Mall cannot create traffic and bus regulations more restrictive than those regulating general motor vehicle traffic. Busses may only que or park in the waiting area designated in the site plan. Busses can only remain in these areas for loading and unloading land and maintain the bus time schedule. Loading and unloading of busses can only occur at waiting areas, shelters or signed stops. Busses cannot be washed or maintained at Rosedale. An operating agreement and restatements thereof for busses at Rosedale was initially approved in 1976. The operating agreement is the prevailing document. The Park and Ride Area is available for transit customers from 5:00 a.m. to 10:00 p.m. weekdays and holidays, for the same term (through 2011) as the Transit Improvements. The Mall owner may temporarily move the park and ride during peak parking periods (usually Thanksgiving through Christmas). The cost of shuttle services to be relocated off-site park and ride lots is shared SO/50 between the Mall, the City and Metro Transit. A set monthly fee is established ($2,750). OTHER ISSUES: 1. New alignment of Transit Hub (waiting area, shelters, 370 - 500 park and ride spaces and park and ride shelter) and bus queing area (2 to 3 lanes) and routers. 2. Establishment of shelter and restrooms at the proposed theatre by Metro Transit in return for 20 year grant and Transit Hub agreement.
