1.2 Design. Equitable shall and prepare the plans and specifications all of the Transit Hub Improvements using guidelines provided by the RTB and this Agreement. Equitable's design and the plans and specifications for the Transit Hub Improvements, shall be generally consistent with the Site Plan and shall be subject to approval by the R TB, which approval shall not be unreasonably withheld or delayed. The following Transit Hub Improvements shall be designed to the following minimum criteria (which criteria shall control any contrary criteria in the guidelines provided by the RTB): (a) the Waiting Area shall have 6lnches of class 5 material and a concrete pad of at least 8-inches of non-reinforced concrete; (b) the Waiting Area Bus Shelter shall be of a material, design and color which is compatible, in the opinion of Equitable, with the other buildings in Rosedale, and shall include a glass-enc 1 osed display case; (c) the Bus Route shall be constructed or reconstructed of a 2-inch hot-mix wear course, a 4-1/2-inch hot-mix binder course and an II-inch class 5 base; and (d) the Park and Ride Bus Shelter shall be of a material, design and color which is compatible, in the opinion of Equitable, with the other buildings in Rosedale shall include a glass-encl9sed display case, and otherwise shall be constructed pursuant to the standard bus shelter specifications used by the Metropolitan Transit Commission (the "MTC"). Equitable shall submit its design, and the plans and specifications, for the Transit Hub Improvements to the R TB for approval when done. If R TB does not disapprove of the design or the plans and specifications, by written notice given to Equitable within 30 business days after submission thereof to the RTB specifying the reasons for the disapproval, then they shall be deemed approved in all respects. If so disapproved by RTB, Equitable shall revise the design, or the plans and specifications, as the case may be, and resubmit them to the RTB for approval and the RTB shall disapprove in writing within the above specified 30 day period or be deemed to have approved the design, and plans and specifications, as the case may be, as submitted. The foregoing process shall be continued until the design, and plans and specifications, are approved or deemed. approved by the R TB. It is understood and agreed that the design shall be first approved, and that the plans and specifications, based on the approved design, shall be subsequently approved, all as above provided.
