<br /> <br /> <br />to <br />located <br /> <br />a <br /> <br />stmcture <br />similar location. <br /> <br />4.2 The Cattelan property has a Comprehensive Land Use designation ofLR, Low Density <br />Residential and an Official Zoning Map designation ofR-l, Single Family Residence <br />District. <br /> <br />4.3 The existing non-conforming detached accessory stmcture is located in the front yard (21 <br />feet from the front propeliy line and is 24 feet by 21 feet or 504 sq. ft. <br /> <br />4.4 The Cattelan parcel is a legal, pre-existing but non-conforming land locked parcel served <br />by a private access easement that provides the legal access and frontage to Lakeview <br />Avenue (to the west of the house). Another lot and house sets between the Cattelan house <br />and the Lakeview Avenue right-of-way. <br /> <br />4.5 In review of the City Code, variances are necessary from Section 1004.01A7 (Location- <br />not in front yard), Section 1004.016 (Residential Dimensional Requirements - Front Yard <br />Setback). <br /> <br />4.6 A CONDITIONAL USE PERMIT (consistent with Sections 1004.01A4 and 1013.01) is <br />necessary if the 1,007 sq. ft. replacement accessory stmcture is to be allowed. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 Section 1 004.01A 7 (Location) does not allow detached accessory structures within a front <br />yard. A front yard is deemed the area from the front wall of the principal structure to the <br />front property line adjacent to a public right of way. <br /> <br />5.2 Section 1004.016 (Residential Dimensional Requirements - Front Yard Setback) requires <br />Single Family Residential parcels to have a minimum front yard setback of 30 feet. A <br />detached accessory structure located in the front yard must meet or exceed the minimum <br />principal stmcture setback to be considered a conforming structure. <br /> <br />5.3 Section 1004.01A4 (Requirements for Increased Size) requires a detached accessory <br />structure between 864 sq. ft. and 1,008 sq. ft. to receive a conditional use permit.
