EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 27th day of January 2003, at 6:30 p.m. The following members were present: Maschka, Kough, Schroeder, Klausing, Kysylyczyn and the following were absent: None Council Member Klausing introduced the following resolution and moved its adoption: RESOLUTION NO. 10070 A RESOLUTION APPROVING A 45 FOOT VARIANCE TO SECTION 1004.02D5 OF THE ROSEVILLE CITY CODE FOR PROPERTY LOCATED AT 331 BURKE AVENUE (PF 3438). WHEREAS, Dennis & Patricia Humphreys have requested a variance to Section 1004.02D5 of the Roseville City Code to allow them to create an additional parcel from their existing 1.15 acre parcel; and WHEREAS, the Humphrey parcel is located at 331 Burke Avenue and legally described at as: The southeast quarter of Lot 7 Thornton's Subdivision of the northeast quarter of Section 13, Town 29, Range 23, according to the recorded plat thereof, City of Roseville, County of Ramsey, Minnesota, PIN: 13-29-23-12-0013 WHEREAS, Section 1004.02D5 requires residential parcels and lots to have a minimum width fronting a public street of 85 feet; and WHEREAS, the Humphrey proposal seeks a parcel for the existing residence of 114 feet and a proposed new parcel with a width fronting a public street of 40.47 feet; and WHEREAS, the Humphrey minor subdivision requires the granting of a 45 foot variance for the newly created parcel; and WHEREAS, the Roseville Planning Commission held the public hearing regarding the Humphrey variance request to Section 1004.02D5 ofthe Roseville City Code on January 8, 2003, and recommended (5-0) approval ofthe variance and minor subdivision request, based on findings outlined in Section 5 and conditions of Section 6 of the project report dated January 8, 2003; 1
