WX <br />80 Section 802.11.13 <br />81 At the request of Member Cihacek related to costs, Mr. Schwartz advised that he <br />82 would check to ensure this was typical ordinance language to define review of <br />83 fees on a periodic basis. <br />84 <br />85 Member Wozniak asked if staff had any concerns with sump pumps draining onto <br />86 adjacent properties. <br />87 <br />88 Mr. Culver responded that staff had discussed this with the City Attorney several <br />89 times, with their advice being that this was a grey area with property rights, and <br />90 more of a civil issue between property owners if and when it occurred. Under <br />91 current code requirements, Mr. Culver advised that drainage and utility easements <br />92 were required for most properties, allowing the City some control over that <br />93 drainage. However, Mr. Culver noted his surprise in reviewing plots, the number <br />94 of Roseville properties never having been platted and under Metes and Bounds <br />95 legal descriptions, making it much more difficult for the City to manage and <br />96 govern those types of situations.
