Attachment B <br />1 <br />2 <br />A.A Type 1 subdivision is intended to be a relatively simple proposal which will <br />3 <br />further develop residential property consistent with the provisions of this Title and Title <br />4 <br />10, Zoning Code, and without significant impacts to the broader neighborhood. Due to <br />5 <br />the inherent simplicity of a Type 1 subdivision, a public hearing is not required. Type 1 <br />6 <br />subdivisions are those which: <br />7 <br />1.pertain to parcels with LDR zoning designations; <br />8 <br />2.comprise adjustments or corrections to the boundaries of existing parcels but do not <br />9 <br />create additional parcels or ownership interests; <br />10 <br />3.do not require new public infrastructure; and <br />11 <br />4.do not require a comprehensive plan amendment, zoning amendment, or variance to <br />12 <br />comply with subdivision or zoning standards. <br />13 <br />B. If any part of a subdivision proposal fails to meet any of the requirements <br />14 <br />for Type 1 subdivisions established in this Section, it shall be ineligible for Type 1 <br />15 <br />subdivision approval; such a proposal must be reviewed as a Type 2 or Type 3 <br />16 <br />subdivision as may be appropriate. <br />17 <br />C. <br />18 <br />1. When a survey or description of a parcel or lot has been found to be <br />19 <br />inadequate to describe the actual boundaries, approval of a corrective subdivision <br />20 <br />may be requested. <br />21 <br />2. Transfer of land area from one recorded lot or parcel to an abutting <br />22 <br />lot or parcel while preserving the total number of parcels. No parcel shall be <br />23 <br />recombined in such a way that more than one zoning designation applies to the <br />24 <br />recombined parcel; such zoning conflicts must be resolved by rezoning, which <br />25 <br />renders the proposal ineligible for Type 1 subdivision approval. <br />26 <br />3. Combining two or more abutting lots of record into a single, larger <br />27 <br />lot. Consolidation as such is different from “combining” for purposes of simplifying <br />28 <br />tax billing. No lots shall be consolidated in such a way that more than one zoning <br />29 <br />designation applies to the consolidated lot; such zoning conflicts must be resolved by <br />30 <br />rezoning, which renders the proposal ineligible for Type 1 subdivision approval. <br />31 <br />Page 1 of 13 <br /> <br />
