The owner(s) of property involved in a Type 1 subdivision proposal <br />33 <br />shall file an application for approval of the subdivision by paying the fee set forth in <br />34 <br />Chapter 314 of this Code and submitting a completed application form and supporting <br />35 <br />documents as set forth on the application form. <br />36 <br />2. Complete applications shall be reviewed by the Development Review <br />37 <br />Committee (DRC) to verify that all parcels involved conform to all applicable zoning <br />38 <br />and subdivision standards and to ensure that approval of the request will not be <br />39 <br />injurious to the surrounding neighborhood and will not otherwise harm the public <br />40 <br />health, safety, and general welfare. <br />41 <br />3. Upon receiving input from the DRC, the Community Development <br />42 <br />Department shall have the authority to approve or deny the request. Alternatively, the <br />43 <br />Community Development Department may determine that an application is unusually <br />44 <br />complex and refer it to the Planning Commission for review and recommendation and <br />45 <br />to the City Council for final action. Type 1 subdivision applications shall receive final <br />46 <br />action approving or denying the request within 120 days following delivery of <br />47 <br />complete application by the applicant, unless an extension of the review period has <br />48 <br />been agreed to by the applicant, pursuant to Minn. Stat. 462.385 Subd. 3b. <br />49 <br />E. <br />50 <br />1.An appeal of an administrative action approving or denying a Type 1 subdivision may <br />51 <br />be filed by any property owner or their agent. <br />52 <br />a.The appeal shall be submitted to the City Manager within 10 calendar days after <br />53 <br />the action being appealed. <br />54 <br />b.The appeal shall state the specific grounds upon which the appeal is made. <br />55 <br />c.The appeal shall be accompanied by the fee set forth in Chapter 314 of this Code. <br />56 <br />2.When an appeal is filed, a public meeting regarding the matter shall be held before <br />57 <br />the City Council, acting as the Board of Adjustments and Appeals, at a regular <br />58 <br />meeting held within 30 days of the receipt of the appeal. The Board of Adjustments <br />59 <br />and Appeals will reconsider only the evidence that had previously been considered as <br />60 <br />part of the formal action that is the subject of the appeal. New or additional <br />61 <br />information from the appeals applicant(s) may be considered by the Board of <br />62 <br />Adjustments and Appeals at its sole discretion, if that information serves to clarify <br />63 <br />information previously considered by staff. A mailed notice of the public meeting at <br />64 <br />which the appeal is to be considered will be sent to the appeals applicant(s) as well as <br />65 <br />the owner of the subject property. <br />66 <br />Page 2 of 13 <br /> <br />
