<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council ofthe City of <br />Roseville, County of Ramsey, Minnesota, was held on the 2nd day of June, 2003, at 6:30 p.m. <br /> <br />The following members were present: Schroeder, Klausing, Maschka, and Kysylyczyn <br /> <br />and the following were absent: Kough <br />Council Member Maschka introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10101 <br />A RESOLUTION APPROVING A 5 FOOT VARIANCE <br />TO SECTION 1004.01A7 AND 1004.02D4 OF THE ROSEVILLE CITY CODE <br />FOR PROPERTY LOCATED AT 421 CRESCENT LANE (pF 3468) <br /> <br />WHEREAS, Manuel Gutierrez has requested a variance to Section 1004.01A7 (Location) <br />and I004.02D4 (Side Yard Setback Adjacent a Public Street) of the Roseville City Code to allow <br />the construction of a 24 foot by 30 foot (720 sq. ft.) detached accessory building (garage); and <br /> <br />WHEREAS, the Gutierrez parcel is located at 421 Crescent Lane and legally described <br /> <br />as: <br /> <br />Lot 21, Block 3, McCarron's Addition <br /> <br />P]1>:13-29-23-21-0064 <br />WHEREAS, Section 1004.01A7 of the Roseville City Code does not allow an accessory <br />building to be located in a front yard; and <br /> <br />WHEREAS, Section 1004.02D4 of the Roseville City Code requires a minimum setback <br />adjacent a public street of 30 feet; and <br /> <br />WHEREAS, the Gutierrez request would locate (construct) the detached garage 25 feet <br />from the property line adjacent to Irene Street or an encroachment of 5 feet into the required 390 <br />foot setback; and <br /> <br />WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br />Gutierrez variance requests (Section 1004.01A7 & 1004.02D4) on May 7, 2003, and <br />recommended (5-0) approval of the request, based on findings outlined in Section 5 and <br />conditions of Section 6 of the project report dated May 7, 2003. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant Manuel <br />Gutierrez a 5 foot VARIANCE to Section 1004.01A7 (Location) and 1004.02D4 (Side Yard <br />Setback Adjacent a Public Street) of the Roseville City Code allowing the construction a 24 foot <br />by 30 foot (720) detached accessory building (garage) at 421 Crescent Lane, subject to the <br />following conditions: <br />1. The applicant locating the lot's property pins and based on that, developing a <br />scaled site plan with dimensions for structures and driveway, thus allowing the <br /> <br />1 <br />
