Attachment E <br />EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARD OF THE CITY OF ROSEVILLE <br />1 Pursuant to due call and notice thereof, a public hearing was held at the regular meeting of the <br />2 Variance Board of the City of Roseville, County of Ramsey, Minnesota, on the 3`d day of <br />3 December 2014, at 5:30 p.m. <br />4 The following members were present: <br />5 and was absent. <br />6 Variance Board Member introduced the following resolution and moved its adoption: <br />7 VB RESOLUTION NO. 110 <br />s A RESOLUTION APPROVING A VARIANCE TO §1004.08 (IMPROVEMENT AREA) <br />9 OF THE CITY CODE TO ALLOW THE PROPOSED EXCESS PAVED SURFACES <br />10 AND BUILDING FOOTPRINTS AT 365 S OWASSO BOULEVARD (PF14-030) <br />11 WHEREAS, the subject property is legally described as: <br />12 PIN: 01-29-23-12-0072 <br />13 All of Lot 7 of Lake Owasso Villa and Lot 8 of Lake Owasso Villa save and except that <br />14 portion of said Lot 8 described as follows: Beginning at the Northwesterly corner of Lot 8 <br />15 Lake Owosso Villa, thence Northeasterly along the Northerly line of said Lot 8 for a <br />16 distance of 40 feet; thence Southerly to a point on the Southerly line of said Lot 8, 30 feet <br />17 Easterly of the Southwesterly corner of said Lot 8; thence Westerly along the Southerly line <br />18 of said Lot 8, 30 feet to the Southwesterly corner thereof; thence Northerly along the <br />19 Westerly line of sold Lot 8 to the Northwesterly corner of said Lot 8, being the point of <br />20 beginning, Ramsey County, Minnesota. <br />21 WHEREAS, City Code §1004.08 limits paved surfaces and building footprints to 25% of <br />22 the parcel area of the subject property; and <br />23 WHEREAS, Zawadski Homes, Inc., owner of the subject property, has requested a <br />24 variances to City Code §1004.08 to allow proposed paved surfaces and building footprints <br />25 covering 29.9% of the property; and <br />26 WHEREAS, City Code §1009.04 (Variances) establishes that the purpose of a variance is <br />27 "to permit adjustment to the zoning regulations where there are practical difficulties applying to a <br />23 parcel of land or building that prevent the property from being used to the extent intended by the <br />29 zoning;" and <br />30 WHEREAS, the Variance Board has made the following findings: <br />31 a. The practical difficulty stems from the fact that the proposed improvements would <br />32 likely be permitted by amended zoning provisions currently being prepared by <br />33 Roseville's Engineering Division staff, but the amendment may take a considerable <br />Page 1 of 3 <br />
