18 ownership approval documentation will be required at submittal of documents necessary for City
9 signatures and prior to plat recording.
20 RECOMMENDATION
2 The amended CIC plat meets or exceeds a11 applicable requirements, however, after the Planning
22 Commission hearing on this matter, the City Planner determined the following condition should
23 be included in the approval.
24 l. The applicant/property owner is esponsible for providing witten evidence of approval to
25 nodify Unit 6 from the Condo Association, thus allowing a small potion of common area to
26 be added into the building aea.
2 Since the Council's approval, the City Planner has worlced with the applicant on completing all
28 final documents however, compiling all necessary signatures of approval from the ownership
2g group is still being completed. With that said, the City Planner would offer a slightly modified
so tp the previous conditional of approval to allow the project to move forward:
3 1. The applicant/property owner is responsible for providing written evidence, in a orrn
32 acceptable to the Citv Attone, of approval to modify Unit 6 fom the Condo Association,
33 thus allowing a small portion of common area to be added into the building area. The
34 written evidence o ownership aproval shall be submitted at the time final documents are
s5 submittedefo Citv sinatures and cannot be released for recordin until received.
36
37
38
39
Based on the comments and findings outlined above, the Planning Division recommends
approval of the proposed A1tE1vDED CIC PLAT pursuant to Title 11 of the Roseville City Code.
PARK DEDICATION
On June 2, 2015, the Roseville Park and Recreation Commission considered whether the
4o proposed amended CIC plat required park dedication and determined that a fee in lieu of land
4 dedication in the amount of $50,106 (7% of fair market value of Unit 6) should be assessed to
42 the project. However, after review of State Statutes and the Roseville City C regarding park
43 dedication requirements, the City Attorney does not feel we the City can charge park dedication
44
45
as part of this approval.
RECOMMENDED ACTION
46 Adopt a resolution approving the proposed change to Unit 6 of Rosedale Corporate Plaza
4 Condominium AtvtElvnEn CIC PLAT based on the comments and finding that the proposed final
48 amended CIC plat is consistent with the preliminary amended CIC plat and reflects the
49 applicable condition of the preliminary approval.
50
51
52
53
54
ALTERNATIVE ACTIONS
Pass a motion to table the item for future action. Per Minnesota State Statutes §462.358, the
City Council has until September 12, 2015, (60 days) to approve/deny the request before an
extension is necessary.
PF15-005 RCA FinalPlat 072015.doc
