any costs and/or engineering services related to said mitigation and changes to the in-place <br /> agreement between Roseville and Rice Creek Watershed District will be the sole <br /> responsibility of the applicant; <br /> 3. The developer/applicant shall continue working with the Roseville Public Works Department <br /> to address easements (including trail) and water and sewer infrastructure requirements as <br /> necessary. These plans must be approved by the City Engineer prior to submittal of the <br /> FINAL PLAT for City signatures; <br /> 4. The developer shall dedicate and maintain access easements across its lot in a form <br /> acceptable to the City Attorney to ensure permanent access to Mount Ridge Road and from <br /> Twin Lakes Parkway for the adjacent parcel; and <br /> 5. The developer shall enter into shared parking agreements in a form acceptable to the City <br /> Attorney to ensure parking needs are met during extraordinary events. The shared parking <br /> agreement between the lots within this subdivision shall be permanent, since they are single <br /> ownership. However, the shared parking agreement with the property to the north will have <br /> an exit clause to protect each owner's rights in case of parking abuse by the adjacent <br /> property, since they are not under the same ownership. This property is proposed to be <br /> parked at the maximum number of surface parking spaces allowed by the Code. Any parking <br /> expansion would need to be contained in a parking structure per Code. <br /> 6. Pursuant to City Code§1103.07, the City Council will accept park dedication of cash in lieu <br /> of land in the amount of$123,298 or 7%of the Fair Market Value of the property. The park <br /> dedication shall be made by the applicant before the signed final plat is released for <br /> recording at Ramsey County. <br /> 7. Additional review related to specific utility design and connections as well as storm water <br /> requirements will be made at the time of a formal building permit application. The applicant <br /> is advised that their drainage report should specifically identify the impacts to the in place <br /> storm water devices for the right in (and the right out if ultimately approved) and also <br /> identify the specific mitigation for that disturbance. <br /> 8. While approval of the final plat does not memorialize access as shown in the submittal, it <br /> should be noted that staff has not approved the right-out access onto Twin Lakes Parkway. It <br /> is the determination of staff that without knowing more specific information about the actual <br /> users of the proposed buildings we don't have enough information to justify the added <br /> disturbance to the in place storm water devices along Twin Lakes Parkway. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Council <br /> Member Willmus and upon a vote being taken thereon, the following voted in favor: Willmus, <br /> Laliberte, Etten, McGehee, Roe and none voted against. <br /> WHEREUPON said resolution was declared duly passed and adopted. <br /> Page 2 of 3 <br />
