<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 22nd day of September, 2003, at 6:30 <br />p.m. <br /> <br />The following members were present: Maschka, Klausing, Kough and Kysylyczyn <br />and the following were absent: Schroeder <br /> <br />Council Member Maschka introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10145 <br />A RESOLUTION APPROVING A VARIANCE TO SECTION 1012.02B & C OF THE <br />ROSEVILLE CITY CODE FOR CHARLES ANDERSON, <br />303 SOUTH OW ASSO BOULEVARD (PF3512). <br /> <br />WHEREAS, Charles Anderson requested a Variance to Section lOl2.02B & C (Fence <br />Height) of the Roseville City Code to allow the installation of a 9 foot tall fence around a portion <br />of his yard; and <br /> <br />WHEREAS, the Anderson residence is located at 303 South Owasso Boulevard, and <br />legally described as: <br /> <br />The South 500 feet of Lot 18, Map of A.K. Barnum's Garden Lots, except the South 1 acre <br />of that part of Lot 18, A.K. Barnum's Garden Lots lying North of the North line of South <br />Lake Owasso Boulevard. <br /> <br />PIN: 01-29-23-12-0026 <br /> <br />WHEREAS, Section lOl2.02B & C limits the height offences within side and rear yards <br />to a height of 6-1/2 feet and in front yards to a height of 4 feet; and <br /> <br />WHEREAS, Mr. Anderson has requested a Variance to allow the installation of a 6 inch <br />by 6 inch heavy gage wire mesh fence to a height of9 feet to deter and or, eliminate deer from <br />entering his flower and vegetable garden; and <br /> <br />WHEREAS, Mr. Anderson has tried a number of reasonable and costly methods for <br />deterring or distracting the deer that enter and damage his flowers, trees, and vegetables; and <br /> <br />WHEREAS, The Roseville Planning Commission held the public hearing regarding the <br />Anderson request on September 3,2003, recommending (7-0) approval of the variance request <br />based on the findings of Section 5 and conditions of Section 6 of the project report dated <br />September 3,2003; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Charles Anderson for a VARIANCE to Section lOl2.02B & C (Fence Height) of <br /> <br />1 <br />
