P <br />ROPOSAL <br />4 <br />In August 2013,Hand In hand Christian Montessori(HIH)received interim use approval for a <br />5 <br />temporary classroom facility to be located on the property until August 31, 2016. The interim use <br />6 <br />approval was necessitatedbythe fact that the proposed structure would not conform to the design <br />7 <br />standards in the INST District, which would likely require additional door and window openings <br />8 <br />in the façade, as well as horizontal articulations of the exterior walls.The original intent was to <br />9 <br />utilize the temporary, prefabricated structure for the 2013 –2014 and 2014 –2015 school years, <br />10 <br />as HIH decided whether to pursue a permanent expansion at this location or to find a more <br />11 <br />suitable location elsewhere. The original interim use approval would have also allowedample <br />12 <br />additional time to remove the structure. As it turned out, the additional time required to address <br />13 <br />building code requirements and weather in fall 2013 led to the structure being unavailable until <br />14 <br />the 2014 –2015 school year. The present interim use renewal application is intended not only to <br />15 <br />compensate for the missed 2013 –2014 academic year, but also to occupy the temporary <br />16 <br />structure for an additional two academicyears. <br />17 <br />Once the building code requirements were worked through following the initial interim use <br />18 <br />approval, the appearance of the structure had changed considerably from what was reviewed with <br />19 <br />the interim use application, butthe size and nature of the building remained consistent with the <br />20 <br />approval.Theroof pitchlap siding used on theexisting structurehave a more residential <br />21 <br />character than the originally-proposed modular structure, but it still fails to conform to the design <br />22 <br />requirements in the zoning code. Therefore, renewed approval as an interim use is required in <br />23 <br />order for the structure to remain on site after August 2016.The original plans from 2013, City <br />24 <br />Council Resolution 11087 approving the existing interim use, recent satellite imagery, and <br />25 <br />current photographs of the existing structureare includedwith this report as Attachment B. <br />26 <br />RIUA <br />EVIEW OF NTERIM SE PPLICATION <br />27 <br />Section 1009.03 of the City Code establishes the regulations pertaining to .The <br />28 INTERIM USES <br />purpose statement for this section indicates that:Certain land uses might not be consistent with <br />29 <br />the land uses designated in the Comprehensive Land Use Plan, and they might also fail to meet <br />30 <br />all of the zoning standards established for the district within which they are proposed; some such <br />31 <br />land uses may, however, be acceptable or even beneficial if reviewed and provisionally approved <br />32 <br />for a limited period of time. The purpose of the interim use review process is to allow the <br />33 <br />approval of interim uses on a case-by-case basis; approved interim uses shall have a definite end <br />34 <br />date and may be subject to specific conditions considered reasonable and/or necessary for the <br />35 <br />protection of the public health, safety, and general welfare. <br />36 <br />Section 1009.03Dof the City Code specifies that three specific findings must be made in order to <br />37 <br />approve a proposed : <br />38 INTERIM USE <br />a. <br />Theproposed use will not impose additional costs on the public if it is necessary for the <br />39 <br />public to take the property in the future. <br />40 <br />b. <br />The proposed use will not create an excessive burden on parks, streets, and other public <br />41 <br />facilities. <br />42 <br />c. <br />The proposed use will not be injurious to the surrounding neighborhood or otherwise <br />43 <br />harm the public health, safety, and general welfare. <br />44 <br />Although an interim use requires findings, similar to conditional use and variances, actions <br />45 <br />taken on interim use proposals are legislative in nature, which gives the City discretion to deny <br />46 <br />interim use applications even though it might satisfy the findings.
