Regular City Council Meeting <br />Monday, Septembe� 14, 2015 <br />Page 10 <br />public notice in accordance with City policy, with no comments received by staff <br />to-date. <br />Mr. Freihammer clarified that, as part of the proposed improvements for this pro- <br />ject, the developer would need to enter into a public improvement contract for re- <br />location of the sanitary sewer line and would bear the responsibility for those <br />costs, with no financial impact to the City as a result. <br />Mayor Roe opened the public hearing at approximately 6:59 p.m. for the purpose <br />of considering vacation of the sewer easement as noted. <br />Public Comment <br />Ann Eerry, 1059 Woodhill Drive <br />Ms. Berry expressed her trust that the City would deal with this sewer line reloca- <br />tion without any problem. However, on a related note as a resident living direct- <br />ly across from this development, Ms. Berry asked if the location of the main en- <br />trance to this project site had yet been finalized, expressing her hope that it would <br />not be directly across from her hoine as she anticipated selling it in the near fu- <br />ture. <br />While not yet final, Mayor Roe responded by pointing out on the displayed map <br />that the intent was to line up the main entrance with Churchill Street just west of <br />Ms. Berry's property, with no cut directly across the street from her property ac- <br />cess. <br />With no one else appearing Mayor Roe closed the public hearing at approximately <br />7:03 p.m. <br />At the request of Mayor Roe, Mr. Freihammer clarified that tonight's action was <br />to vacate the existing easement, and the new easement was not being dedicated at <br />this point pending final plat approval, <br />14. Approve/Deny Vacation of Easement for Cherrywood Pointe <br />McGehee moved, Willmus seconded, adoption of Resolution No. 11253 (Attach- <br />ment A) entitled, "Resohition Approving the Vacation of a Sewer Easement Lo- <br />cated in the W'/ of the SW '/ of Sec. 2, Twp. 29, Rng. 2." <br />Roll Call <br />Ayes: Willmus, Laliberte, Etten, McGehee and Roe. <br />Nays: None. <br />b.
