7 9 6.0 <br />80 <br />81 <br />82 <br />83 <br />84 <br />85 <br />86 <br />87 <br />88 <br />89 <br />90 <br />91 <br />9 2 7.0 <br />Attachment F <br />DEVELOPMENT of PROPERTY: <br />Failure by the DEVELOPER to commence and diligently undertake development activity <br />for the Retail Addition and Parking Deck in accordance with the final development <br />PLANS within two years of the effective date of this AGREEMENT will necessitate the <br />DEVELOPER seeking approval of an extension of the development schedule by the <br />Community Development Director within 60 days after the conclusion of the two-year <br />period, which shall not be unreasonably withheld. If an extension is not applied for, the <br />Counci] may instruct the Planning Commission to initiate rezoning to the original land <br />use plan and zoning districts or to another zoning designation consistent with the <br />Comprehensive Plan. For purposes of this provision, development activity shall be <br />defined as obtaining a building permit, commencing and continuing with PROJECT <br />construction on the site. Section 6.0 shall not apply to the development of the <br />COMMERCIAL PADS. <br />COMPLIANCE with LAWS and REGULATIONS: <br />93 The DEVELOPER represents to the CITY that, to the best of its knowledge, any site <br />94 improvements pursuant to the proposed PROJECT will comply with all City, County, <br />9 5 Watershed, Regional, Metropolitan, State, and Federal laws and regulations, including <br />96 but not limited to the Roseville Subdivision Regulations, the Roseville Zoning <br />97 Regulations as modified by this AGREEMENT, and all other applicable environmental <br />9 8 regulations. <br />9 9 8.0 <br />100 <br />101 <br />SITE DEVELOPMENT REQUIREMENTS: <br />To ensure that the proposed development meets the CITY'S requirements and standards <br />for site development, the following provisions shall apply: <br />10 2 8.1 Final Utility Servicing Plan. The final utility servicing plan for each property <br />10 3 and/or site must be reviewed and approved by the Public Works Director prior to <br />104 any permits being issued for any building in the Project. <br />10 5 8.2 Erosion Cont�ol. Prior to site grading, and before any utility construction is <br />10 6 commenced or building permits are issued, an erosion control plan must be <br />10 7 submitted for approval by the Public Works Director and/or the Rice Creek <br />10 8 Watershed, and all erosion control actions shall be implemented, inspected and <br />l 0 9 approved by the CITY. <br />110 <br />111 <br />112 <br />113 <br />114 <br />115 <br />8.3 Clean Up. The DEVELOPER shall clean dirt and debris from public streets that <br />has resulted from construction wark by said DEVELOPER or DEVELOPER'S <br />CONTRACTORS, i�s agents or assigns. The CITY will determine whether it is <br />necessary to take additional measures to clean dirt and debris from the streets. <br />After 24-hour verbal notice to the DEVELOPER, the CITY may complete or <br />contract to complete the clean up at the DEVELOPER' S expense. <br />116 8.4 Public Roadway Easement. The DEVELOPER shall dedicate the right-of-way <br />117 along County Road B2 (east and west sides of the access) as generally depicted in <br />118 Exhibit E for the purpose of reconstructing the dedicated right turn lane into <br />119 Rosedale from County Road B2 at the exit ramp from Snelling Avenue, which <br />12 0 may be necessary for the construction of the required westbound second left turn <br />11/11/15 Ver. <br />
