Attachment B <br />Extract of the October 7, 2015, Roseville Planning Commission <br />Meeting Minutes <br />3 Public Hearings <br />4 Chair Boguszewski reviewed the protocol for public hearings and subsequent process. <br />PROJEC FILE <br />Re uest by the City of Roseville for approval of amendments to City Code Chapter <br />pertaining to tree preservation replacement and landscaping re uirements <br />Chair Boguszewski opened the public hearing for PROJECT FILE 0017 at 6:30 p.m. <br />9 City Planner Thomas Paschke provided a brief history in revisions to the existing tree preservation <br />10 ordinance process to-date; and deferred to the City's Tree Consultant, Ben Gozola of Sambatek and <br />11 Mark Rehder, Subcontractor and Consultant with S& S Tree for a more detailed discussion. <br />12 As part of tonighYs review process, and as detailed in the staff report and attachments dated October 7, <br />13 2015, Chair Boguszewski reviewed options for the Commission related to this iteration of the revised <br />14 Tree Preservation and Restoration Ordinance. <br />15 Mr. Gozola provided a revised draft ordinance (REVISED Attachment B) as a bench handout, attached <br />16 hereto and made a part hereof, with minor edits beyond the draft included in the agenda materials, <br />17 advising that he would speak to them as part of his presentation. <br />18 Ben Gozola AICP Sambate <br />19 Mr. Gozola provided a history of ordinance revisions to-date, including initial review by the City County <br />20 subsequent to their request for the Planning Commission to review this latest version for their feedback. <br />21 As part of his presentation, Mr. Gozola reviewed the broad goals brought forward at the initial July 2015 <br />22 meeting, purpose for the ordinance, and desire to provide incentives to preserve trees in the community <br />23 without overburdening individual property owners while ensuring proper oversight of this valuable <br />24 community asset. <br />25 Mr. Gozola reviewed attachments included in the meeting packet, including Attachment D providing a <br />26 clean copy of the draft tree preservation ordinance for tonight's review and public comment. Mr. Gozola <br />27 reviewed cover memoranda related to tonight's discussion providing explanations of each section as well <br />28 as areas where additional feedback was being sought based on reviews to-date at various levels. <br />29 Previous Ordinance <br />30 Mr. Gozola advised that language retained from the previous Tree Preservation Ordinance was not <br />31 incorporated into Section 4 of the new draft ordinance and outlined in the Memorandum to Attachment D <br />32 dated October 6, 2015 related to this proposed final draft. <br />33 Mr. Gozola advised that note item to note was revision of "specimen" trees to "significant" trees. <br />34 Mr. Gozola also noted that Attachment A had been mission specifics for "cash in lieu of" payments as an <br />35 option for tree locations or relocations as applicable, with Attachment B, lines 344 — 346 now addressing <br />36 that area based on best practices and guarding against claims that fees may be deemed unreasonable. <br />37 Ms. Gozola noted that in accordance with the City of Roseville's policy to establish fees by policy or <br />38 resolution rather than in specific ordinances, fees were not included in the proposed draft ordinance. <br />39 In an effort to provide examples of practical application of the ordinance using previous developments in <br />40 Roseville (e.g. Cherrywood Point, Pulte Homes), Mr. Gozola reviewed how those comparisons would <br />41 address tree inventories and differentials between the two ordinances, including how numbers would be <br />42 impacted or exemptions applied, even though he admitted it was difficult to compare apples to apples in <br />43 those cases. <br />44 For discussion purposes and to avoid confusion, Mr. Gozola suggested using the draft ordinance <br />45 provided as a bench handout (Revised Attachment B) as the reference going forward. <br />46 Commission Discussion/Questions <br />47 Page 1, line 27, Member Bull questioned multi-stem trees (e.g. Birch) and rationale for measuring them <br />48 as one tree using the diameter breast height (DBH) of the largest stem only. <br />
