<br />communication; or a service which entitles a subscriber <br />or user, upon the paYment of a periodic charge which is <br />determined as a flat amount or upon the basis of the <br />total elapsed transmission time, to the privilege of an <br />unlimited number of telephonic communications to or from <br />all or a substantial portion of the persons having <br />telephone or radio telephone stations in a specified area <br />which is outside the LATA in which the station provided <br />with the services is located. <br /> <br />O. Total Gross Revenues <br />All cash, credits, or property of an kind or nature <br />reported as revenue items to the Franchisee's audited <br />income statements, or the income statements of any <br />affiliate or subsidiary, arising from or attributable to <br />the sale, lease, rental or exchange of wireless <br />communications services or equipment by the Franchisee <br />within the City or in any way derived from the operation <br />of its Wireless Communications System, including, but not <br />limited to, any interconnection between its system in the <br />City and any system whatsoever. This sum shall be the <br />basis for computing the gross revenue fees imposed <br />pursuant to this Ordinance. Such sum shall not include <br />any vendor discounts or credits nor sales tax, service, <br />occupational or other excise tax to the extent that such <br />taxes are charged separately from normal service charges <br />and are remitted by the Franchisee directly to the taxing <br />authority. <br /> <br />SECTION 3. ORDINANCE <br /> <br />The City Council hereby resolves that: <br /> <br />The City Council will grant non-exclusive franchises for the <br />installation of fiber optic cable, network cable and associated <br />equipment on, over and under the public ways and places of the City <br />in connection with the provision of Wireless Telecommunications <br />Services in the City. <br /> <br />The Public service provided pursuant to this Ordinance shall be <br />Wireless Telecommunications Service. <br /> <br />All franchises granted pursuant to this Ordinance shall require the <br />approval of the City Council. <br /> <br />SECTION 4. REOUEST FOR PROPOSAL (RFP) REOUIREMENTS <br /> <br />Prior to the grant of any such franchise a Request for Proposal <br />(RFP) shall be issued by the City Council. The Criteria to be used <br />to evaluate responses to such RFP's or other such solicitations <br />shall include, but not be limited to, the following: <br /> <br />A.
