<br />B. The financial, legal, technical and managerial experience <br />and capabilities of the applicant(s); <br /> <br />C. The ability of the applicant(s) to maintain and protect <br />the property of the City and to protect the property of <br />the citizens of the City during the term of the <br />franchise; <br /> <br />D. The value, efficiency and quality of the public service <br />to be provided; and <br /> <br />E. The value of any telecommunications facilities and <br />services offered by the applicant(s) to the City. <br /> <br />SECTION 5. FRANCHISE CONDITION <br /> <br />Any franchise granted pursuant to this authorizing Ordinance shall <br />be by written agreement which shall include, but not be limited to, <br />the following terms and conditions: <br /> <br />A. The term of any franchise issued hereunder shall not <br />exceed five (5) years. <br /> <br />B. The compensation to be paid to the City shall be adequate <br />and may include the paYment of fees or the provision of <br />facilities or services or both. <br /> <br />C. The franchise may be terminated or cancelled in the event <br />of the Franchisee's failure to comply with the material <br />terms and conditions of the agreement. <br /> <br />D. A security fund in the form of performance bonds shall be <br />established to ensure the performance of the Franchisee's <br />obligations under the agreement. Such performance bonds <br />shall not be less than $1,000,000. <br /> <br />E. The City shall have the right to inspect the facilities <br />of the Franchisee and to order the relocation of such <br />facilities at the direction of the City Engineering <br />Department. <br /> <br />F. There shall be adequate insurance and indemnification <br />requirements, as determined by the City, listing the City <br />as additional insureds. <br /> <br />G. All Franchisees shall be required to maintain complete <br />and accurate books of accounts and records within the <br />City which shall be made available on demand to the City <br />for inspection. <br /> <br />5 <br />
