ORDINANCE NO. 1155 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF ROSEVILLE AN ORDINANCE PERTAINING TO WIRELESS TELECOMMUNICATIONS SYSTEMS AND AMENDING ORDINANCE 1147, AMENDING ORDINANCE 1148 AND AMENDING ORDINANCE 1149 The City Council of the City of Roseville does hereby ordain: I. Section 3 of Ordinance 1147 is hereby amended to read as follows: Section 3. Ordinance The City Council hereby resolves that: The City Council will grant non-exclusive franchises for the installation of fiber optic cable, network cable and associated equipment on, over and under the public ways and places of the City in connection with the provision of Wireless Telecommunications Services in the City. An operator of a Wireless Telecommunications System who has a valid Lease Agreement with the City to pay rent and/or other consideration to the City for use of City land to construct and/or operate such a system shall not be required to obtain a franchise, unless such Lease Agreement specifically states that a franchise shall be required to operate the system. The Public service provided pursuant to this Ordinance shall be Wireless Telecommunications Service. All franchises granted to this Ordinance shall require the approval of the City Council. II. Section 2A of Ordinance 1148 is hereby amended to read as follows: A. Permit Requirement No person, firm or corporation whether public, private, nonprofit or not for profit shall construct, operate or continue to operate a Wireless Communications System which occupies any part of the easements, streets, public ways and public places within the city without having been issued a Wireless Telecommunications Permit by the City.
