<br />18.020.51 Variance. " Variance" means the same as that term is defined or described in <br />Minnesota Statutes Chapter 462 (for municipalities). <br /> <br />18.020.52 Water-oriented accessory structure or facility. "Water-oriented accessory <br />structure or facility" means a small, above ground building or other improvement, (except <br />stairways, fences, docks, and retaining walls), which, because of the relationship of its use to a <br />surface water feature, reasonably needs to be located closer to public waters than the normal <br />structure setback. Examples of such structures and facilities include boathouses, gazebos, screen <br />houses, fish houses, pump houses, and detached decks. <br /> <br />18.020.53 Wetland. " Wetland" means a land form that is transitional between terrestrial and <br />aquatic systems as defined in Minnesota Statutes, Section 103G.005, Subd. 19. <br /> <br />18.020.54 Wetland boundary. "Wetland Boundary" means the boundary line between what is <br />considered to be upland and wetland using the methodology for delineating wetlands as <br />prescribed in Minnesota Statutes, Section 103G.2242: Subd. 2. <br /> <br />18.021 Disclaimer. This Chapter does not imply that areas outside of the Shoreland, Wetland <br />and Storm Water Management Overlay District or land uses permitted within that district will be <br />free from flooding or flood damages. The Chapter does not create liability on the part of the City <br />or its officers or employees for an flood damage that may result from reliance on this Chapter or <br />any administrative decision made under it. <br /> <br />18.022 Enforcement Compliance. The use of any shore land of public waters, the size and <br />shape oflots, the use, size, type and location of structures on lots; the installation and <br />maintenance of water supply and waste disposal facilities;. the filling, grading, lagooning, or <br />dredging of any shore land area; the cutting of shore land vegetation; and the subdivision of lots <br />shall be in full compliance with the terms of this chapter and other applicable regulations. <br />Construction of buildings, water supply and City utility service systems and erection of signs shall <br />require a permit, unless otherwise expressly excluded by the requirements of this chapter. <br /> <br />18.023 Interpretation. In their interpretation and application, the provisions of this ordinance <br />shall be held to be minimum requirements and shall be liberally construed in favor of the <br />governing body and shall not be deemed a limitation or repeal of any other powers granted by <br />State Statutes. <br /> <br />18.024 Severability. If any section, clause, provision, or portion of this ordinance is adjudged <br />unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance <br />shall not be affected thereby. <br /> <br />8 <br />
