Applicability <br />969 L The regulations in this section shall apply to any individual, business or entity that <br />970 applies for one of the below permits or approvals. <br />971 <br />972 <br />973 <br />974 <br />975 <br />976 <br />a. An application for platting, re-plattin�, or any lot division application that does not <br />qualify as a minor lot subdivision; or <br />b. A buildin� permit aqplication to construct a new urincipal structure or seeking to <br />expand the footprint of an existing principal structure by more than 50%; or <br />c. A demolition permit seeking to remove more than 50% of a principal structure in <br />anticipation of immediate or future redevelopment; or <br />977 d. A�radin� permit seeking to add, move, or relocate 50 cubic yards or more in all non- <br />978 Shoreland Management Districts; or 10 cubic yards with the Shoreland Management <br />979 District. <br />•'1 <br />•• <br />. <br />. <br />. <br />.• <br />. <br />•;. <br />•• <br />. <br />•.• <br />2. If the Community Development Department determines that pre-applicaiion tree <br />removal occurred in order to circumvent the re�ulations in this section, the Deuartment <br />may require equivalent tree replacement as if a tree preservation plan had been <br />submitted prior to removal. Pre-application tree removal shall be considered removed <br />within two years of application. Any costs to estimate the removal may be charged to the <br />applicant. Said determinations may be appealed to the Board of Adjustment and <br />Appeals under Section 1009.08 of this Title. <br />987 3. Activities subiect to the provisions of Chapter 1017, Shoreland, Wetland, and Storm <br />988 Water Mana�ement, may require tree preservation beyond that which is required by this <br />989 section. In all such instances, the more restrictive preservation standard shall apply. <br />990 4. In all instances in which submissions by a de�reed forester or certified arborist are <br />991 required, such submissions shall be reviewed and approved bv Citv Staff or contractors <br />992 with equivalent credentials. <br />993 C. Exemptions <br />994 The followin� activities are exempt from the requirements of this Section: <br />995 <br />..� <br />1. Tree removal related to ��� citv public improvements proiects or repairs; <br />2. Emer�ency removal of a tree or trees to protect public health. <br />997 D. Trees Required to be Inventoried <br />998 All deciduous trees measurin� a minimum of six (6) inches at Diameter Breast Height (DBH), <br />999 and all coniferous trees that are twelve (12) feet or more in hei�ht, shall be identified on the <br />1000 tree preservation plan sets required by this section. <br />1001 <br />1002 <br />E. Tree Classifications <br />All trees required to be inventoried shall be assi�ned a classification as follows: <br />1003 1. Herita�e Trees: <br />1004 a. All deciduous trees measuring equal to or greater than twenty-seven (27) inches at <br />1005 DBH, and all coniferous trees measurin� equal to or �reater than fifty (50) feet in <br />1006 height• <br />
