Unauthorized tree removal which results in mandatory replacement shall require the 1275 applicant to prepare or update a final planting plan as required by Section 1276 1011.04(G)(3)(c). Replacement plantin�s shall only occur once authorized by the City 1277 Forester or other degreed forester or certified arborist as assigned bv the Community 1278 Development Department. 1279 L. Certification of Compliance with Approved Landscape Plan 1280 Upon completion of construction activity and/or required landscapin�, the Developer shall 1281 notify the City and request an inspection of the work. Following the inspection, the City shall 1282 notify the Developer that additional work is still required, or issue a letter finding that all 1283 plantings have been satisfactorily completed. The required warranty period for plantings 1284 shall be�in on the date of the issued satisfactorv completion letter. 1285 1286 1287 1288 1289 M. Warranty Requirement 1. New Development Sites: the Developer shall provide a financial guarantee, in a form satisfactory to the City, prior to the approval or issuance of any permit for land alteration a. The amount of the �uarantee shall be 125°/a of the estimated cost to furnish and plant 1290 replacement trees. The estimated cost shall be provided by the Developer subiect to 1291 approval bY the City. The estimated cost shall be at least as much as the reasonable 1292 amount char�ed by nurseries for the furnishin� and planting of replacement trees. 1293 1294 1295 1296 The City reserves the right in its sole discretion to determine the estimated cost in the event the Developer's estimated cost is not approved. b. The security shall be maintained for at least 2 years after the date that the last replacement tree has been planted. Upon a showin� by the Developer and such 1297 inspection as may be made by the City, that portion of the security may be released by 1298 the Citv equal to 125% of the estimated cost of the replacement trees which are alive 1299 and healthy at the end of such year. Any portion of the security not entitled to be 1300 released at the end of the vear shall be maintained and shall secure the Developer's 1301 obligation to remove and replant replacement trees which are not alive or are 1302 1303 1304 1305 1306 unhealthv at the end of such vear and to replant missin� trees. Upon completion of the replantin� of such trees the entire securitv may be released. 2. Development or Redevelopment of Existin� Lots: The developer shall provide a cash escrow in the amount of $500.00 to �uarantee compliance with the requirements of this Ordinance. Said securitv shall be released upon certification of compliance bv the 1307 developer to the satisfaction of the City. Notwithstandin� the fore�oing, no portion of the 1308 security shall be released while there are unsatistied Developer's obligations to indemnify 1309 the City for any expenses in enforcing this requirement. 1310 3. The Citv mav retain from the securitv required above as reimbursement an amount 1311 expended by the City to enforce the provisions of this Section.
