<br />CITY OF ROSEVILLE <br />Ordinance No. 1175A <br /> <br />AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF ROSEVILLE BY <br />ELIMINATING CERTAIN PUBLIC HEARINGS BEFORE THE CITY COUNCIL AND <br />PROVIDING FOR UNIFORM PROCEDURES FOR PUBLIC HEARINGS BY ADDING <br />CHAPTER 108, AND BY AMENDING CERTAIN SECTIONS OF CHAPTERS 201, 405, 406, <br />AND 703. <br /> <br />The City Council of the City of Roseville does hereby ordain: <br /> <br />I. <br /> <br />The City Code of the City of Roseville is hereby amended by adding Chapter 108, to read as <br />follows: <br /> <br />Chapter 108 <br /> <br />Procedure of the City Council and Planning Commission for conducting certain public <br />hearings: <br /> <br />Section 108.01: <br /> <br />A. Hearings. When a public hearing involving the comprehensive plan, zoning or <br />subdivision regulations is required by this Code or by a Minnesota Statute, the Planning <br />Commission shall hold the public hearing. All parties interested shall be given an <br />opportunity to be heard. The Planning Commission, after citing the reason, may request <br />the City Council to extend the review period for up to 60 days. <br /> <br />B. Notice. Notice of the time and place of such hearing shall be published in the <br />designated legal newspaper no less than ten (10) nor more than thirty (30) days prior to <br />the hearing. <br /> <br />In the event the hearing involves a particular parcel of land, mailed notice shall be given <br />by the City to the owner and to each of the property owners within three hundred fifty <br />(350) feet of the outside boundaries of the parcel and to the State, County, and Federal <br />agencies, if applicable. Failure to mail notice or the failure of the property owners to <br />receive the notice shall not invalidate the proceedings. <br /> <br />C. Council Hearings. The City Council shall hold further hearings using the notice <br />procedure in Section 108.01 B only in the event that such hearings are required by other <br />sections of this code, by state statute, or because the Planning Commission has failed <br />to hold the required hearing or make a recommendation. If not previously done in <br />response to a Planning Commission request, the City Council may extend the review <br />period for up to 60 days.
