Chapter 201, Section 201.07 is hereby amended to read as follows: 201.07: PROCEDURE FOR ADOPTION OF CITY COMPREHENSIVE PLAN: The Planning Commission may, at any time, recommend to the City Council, the adoption of the City Comprehensive Plan, any section of it or any substantial amendment thereof. Before making such recommendation to the City Council, the Planning Commission shall hold at least one public hearing, as provided for in Chapter 108. The recommendation by the Planning Commission to the City Council shall be by a resolution of the Commission, approved by the affirmative votes of not less than five- sevenths of its total membership. The Commission may from time to time recommend minor amendments to the City Comprehensive Plan or any section thereof without the public hearing mentioned herein providing that a majority of its members are of the opinion that such hearing is not necessary or in the public interest. III. Chapter 201, Section 201.08 is hereby amended to read as follows: 201.08: ADOPTION OF CITY COMPREHENSIVE PLAN BY CITY COUNCIL: Upon receiving a recommendation from the Planning Commission for the establishment or amendment of a plan, the City Council shall follow procedure as set forth in Chapter 108. The City Council may adopt such plan or amendments by a majority vote of its members or by a larger majority if required by statute. IV. Chapter 201, Section 201.10 is hereby amended to read as follows: 201.10: ZONING CODE AND CITY COMPREHENSIVE PLAN: The Planning Commission may upon its own motion or upon instruction by the City Council, prepare revisions to the Zoning code and/or plan for the City. Before recommending such Code and/or plan to the City Council, the Planning Commission shall hold at least one public hearing as provided for in Chapter 108. The same procedure shall apply for the preparation of any overall street plan or acquisition of lands for public purposes. V. Chapter 405, Section 405.04 is hereby amended to read as follows: 405.04: NOISE VARIANCES: Any person may apply to the City Council for a variance from the requirements of this Chapter prior to doing those acts. The applicant shall provide a certified list of property owners within three hundred fifty feet (350') of the site (s) where the activity is to occur. The Council procedure for public hearings shall be as set forth in Chapter 108. For good cause shown, the City Council may, in its sole discretion, either grant or deny the variance.
