406.04: E. Hearing: The City Council will hold a hearing on each application for a permit to treat or dispose of contaminated soil. Notice of the hearing shall be as provided for in Chapter 108. In determining whether or not a permit shall be issued, the City Council may prohibit such treatment and disposal within the City if it determines that the health, safety, and welfare of residents of the community will be jeopardized by such treatment and disposal within the City after making specific findings concerning the basis of its denial. The City Council may impose reasonable conditions with regard to permits for such treatment and disposal. Chapter 406, Section 406.04, paragraph D is repealed. VII. Chapter 703, Section 703.09, paragraph B is hereby amended to read as follows: 703.09: B. Appeals and Hearings: Appeals from the decision of the Public Works Director in relation to the granting and revoking of a permit shall be referred to the City Council. Such appeal shall be taken within twenty (20) days from and after the date of such decision by the Public Works Director. Upon a motion from the City Council the appeal may be referred to the Planning Commission. If directed by the City Council, the Planning Commission may hold a public hearing on the appeal. The procedure for said public hearing shall be as set forth in Chapter 108. The prosecution for violation of any of the provisions herein shall be held in abeyance pending the determination of the appeal to the City Council.
