<br />406.04: E. Hearing: The City Council will hold a hearing on each application for a permit <br />to treat or dispose of contaminated soil. Notice of the hearing shall be as provided for in <br />Chapter 108. In determining whether or not a permit shall be issued, the City Council may <br />prohibit such treatment and disposal within the City if it determines that the health, safety, and <br />welfare of residents of the community will be jeopardized by such treatment and disposal within <br />the City after making specific findings concerning the basis of its denial. The City Council may <br />impose reasonable conditions with regard to permits for such treatment and disposal. Chapter <br />406, Section 406.04, paragraph D is repealed. <br /> <br />VII. <br /> <br />Chapter 703, Section 703.09, paragraph B is hereby amended to read as follows: <br /> <br />703.09: B. Appeals and Hearings: Appeals from the decision of the Public Works <br />Director in relation to the granting and revoking of a permit shall be referred to the City Council. <br />Such appeal shall be taken within twenty (20) days from and after the date of such decision by <br />the Public Works Director. Upon a motion from the City Council the appeal may be referred to <br />the Planning Commission. If directed by the City Council, the Planning Commission may hold a <br />public hearing on the appeal. The procedure for said public hearing shall be as set forth in <br />Chapter 108.
