<br />702.05: <br /> <br />702.06: <br /> <br />LAKE OW ASSO RESTRICTIONS: Notwithstanding any <br />other provision of this Code to the contrary, the following <br />restrictions apply to the operation of motorboats on Lake <br />Owasso: <br /> <br />A: <br /> <br />Definitions: The following words and phrases when used <br />in this ordinance have the meanings set forth in Minn. Stat. <br />§86B.005: motorboat, operate, person, slow-no wake & <br />watercraft. <br /> <br />B: <br /> <br />No person shall operate a motorboat or be towed on water <br />skis or a similar device at greater than a slow-no wake <br />speed within 150 feet of shore. Launching or landing a <br />skier by the most direct route to open water shall be <br />exempt from this provision. <br /> <br />C: <br /> <br />Persons operating a motorboat, and those being towed on <br />water skis or a similar device shall, at all times, maintain <br />an adequate distance (considering speed and conditions) <br />from other watercraft, swimmers, swim rafts and docks, so <br />as to avoid an accident. When a swimmer is present, <br />motorboats or persons being towed on water skis or a <br />similar device, shall not pass between a swim raft and the <br />nearest shore. <br /> <br />D: <br /> <br />Exemptions: <br /> <br />1. Authorized resource management emergency and <br />enforcement personnel, when acting in the <br />performance of their duties, shall be exempt from <br />the provisions of this ordinance. <br /> <br />2. A temporary exemption from these restrictions for <br />a special event may be granted upon approval by <br />the City Council and the issuance of a permit by the <br />Ramsey County Sheriff's Department. <br /> <br />AIRCRAFT: <br /> <br />A. <br /> <br />Use of Aircraft Declared a Hazard: The City Council finds <br />and determines that there are no public waters (except Lake <br />Owasso) within the City which may be used by aircraft <br />without endangering the property and lives of other persons <br />using the public waters. The City Council finds that all <br />public waters in the City are small and heavily used for <br />boating, fishing and swimming by residents and other <br />people generally and that the use of aircraft on the same <br />
