NOTE:
August 6,
CAS E NO
ias the copy of the August fi, 199 r rt as referred to in the March 4th , L}
rt - Case No.: 528-b9. W e d i d  e c e i v e a n y f u r t h e r i n f o r m a t i o n o n 'i
this case and, therefore, are unable to make any further comments at this time, '''
^1
i
1969
t:
• 528-69
':
A PPL ICA hJT: r'
Standard Oil Cmpany  '
LQCATION: Northwest corner of Fairview Avenue and County Road B-2 , ''
ACTOON REQUESTED: Approval of Division of Land, Special Use Permit for {
Servie Station, and Variance to Setback
PLANNItiG CONSIDERATICNS: .
1. The property in question has 338 feet of frontage on County Road B- and
 267 feet of frontage an Fairview Avenue. The entire ,rcel consists of 2. 182$ ,,s
• acres. The Certificate of Abstract submitted with the appication indicates "
that Standard Oil already owns the southwest corner which measures 152 (on yz
airview) Ib ]75 feet, and thctt the Dayton Development Corporation owns
the remainder, lhus, it would appear thafi the lancl has already been divideci, '}
Th applicrnt, according to the file, is the Standard Oil Company and not
the Dyton Development Gorporation. The proposed division of land as ``
,;
indicated by a skstch submitted wiih the app) icatiQn would (eave a 11.5 71
foot lot narrh oF the proposeci service station on Fairview with g5 feet of •
frontage on the wst side of fhe prperty. This lot also would have a0
foot eaccess to County Road B-2 on the west sile of the property, and would
consist of a total of .93 acres. To the west of the proposed service station
site (shown in crey on the sketch at the left) would be a parcel of fand with
approximatel i72 fet af frontage on County Road B-2 ccnsistin.y of .63
acres. Thus, it woUld appear that the Dayton Develbprr,ent Corporation wauld
be the appliccsr,t for the division of the and. No indications are given as
to tfe reasans fr rhe unusual divisian of te land nor for the proposed uses
they have in mind.
2. The applicant's proposal to construct a service station indicate the site as being 152
feet by 175 feet. rh 175 foot dimensian includes 10 feet of right-af-way
which should be dedicated for the expansion of the Fairview Avenue right-
of-way from 33 feet to the center line to 43 feet, pbviously, as a part of
any platting or dividing of the land in question this 10 feet cf right-of-way
should be dedicted.
3• We are somewhat concerned that the proposed service station sifie is as
minimal as proposed. Normalfy, a 150 by ?50 feet is the absolute minimum
site for a service station tday. At this key intersection, one wovld question
whethcr or not tfe size proposed would be adequate for what will obviously
