If the other party consents to arb?tration, within 5 days after demand, arbitration shall then be conducted in accordance with Article 41, If neither party demands ar�bitration, or if one party does noi, consent to arbitration, t;ien the parties sha11 be lef�t to their legal remedies. However, no demand for~ arbitration of any such claim, dispute or other matter shall be made until the ear�ier of (a) the date on which the ENGINEER has rendered his decision or (b) tl�e tenth day af ter the parties have presented their evidence to the ENGINEER if he has not rendered nis written dec�sion before that date. No demand for arbitration shall be made later than th�rty days after the date on which the ENGINEER rendered and furnished his written decision in respect of the claim, dispute or other matter as to which arbitration is sought; and the failure to demand arbitration within said thirty days' per�od shall result �n a �vaiver of arbitration rights under Article 41, If the ENGINEER rende s a decision after arbitration proceedings ha��e be�n initiated, such deci:ion may be entered as evidence but shall not supersede the arbitration pr,�ceedings. except where the decision is acceptable to the parties concerned� ARTICLE 15 - SHOP DRAWINGS AND SAMPLES 15.1 After checking and verifying all field measurements, the CONTRACTOR shall submit to the ENGINEER, for approval in accordance with the accepted � schedule of Shop Drawings submis�ions, �ive copies (or, at the ENGINEER'S op�ion, �ne reproducible copy) of a�l Shop Drawings, which shall have been checked and approved by the CONTRACTOR, The data shown on the Shop Drawings ' shall be complete with respect to d�mensions, design criteria, materiais of construction and oth�r details to enable the ENGINEER to review the information as requi� �d. �� � � � � L�J 15.2 The CONTRACTOR shall also submit to the ENGINEER for approval, with such promptness as to cause no delay in the l�lork, all samples required by the Contract Documer�tso All samples sha�l be checked and approved by the CON7RACTOR, identified c�early �s �o mater�al, manufacturer, any pertinent catalog numbers and the use far wh�ch intended prior to submitiing them to the ENGINEER. 15.3 At the time of each submission, the CONTRACTQR will, �n writing, call the ENGINEER'S attent�on to any deviations that the Shop Drawing or sample may have from the re�uirements of Contract Documents. 15.4 The ENG[NEER will check and approve, with reasonable promptness, Shop Drawings and samples, but his ch�ckinq and approval shall be limited to review for conformance with the design concept of the Project an� for co�i- pliance with the �nformation given �n the Contr�ct Documents The CONTRACTOR G-9
