• March 19, 1984
-10-
of all the properties involved in the B-4 rezoning just shortly before
tlie zoning was enacted. You will recall this series of pictures, some
of wliich were used in prEsentations to the Planning Commission, Council,
and property owners.
Last Tuesday, David Drown called to inform us that Strick tvas applying
for water connection to the Uuildiiig (it aas previously served Uy a well),
and lle thougltt tlie truck leasing oper;tion liacl ceased after rezoning was
adopted for a periad ipproximating 11 inonths. This brings into play
anotlier section of tlle ordinance, wliiclt states that if a legal nonconforming
use is discontinued for a period grea.rer than six months, it loses its
nonconforming status. At aonferenc ii City Hall, Jim Leary and Mr.
Hirsch were not certain of the dates, and we suggested tliey ascertain
whn the use ceased, and whether during the interim period, any trucks
had been parked on he site. After a meetin at City f-tall, I was abl
tu get a}io:d of Roger Jensen, wlio con£irmed that 3f t}ie operation was
in existence at the time of the rezonings, it was nonconforming; but
if it did cease for aeriocl greater than six months, it lost thut status.
Thus, tl7ere is nov a c{ucstion as to whther r not a new truck loasing
oPeration cn be conducted on the site. They in£ormed us that a fiue-year
lass had ben notited, 1nc that equiment to occuy the site was on route.
{'e wauld certainly muc}s rat}ier sec somo other form o:f more intensiv and
higlir quality development occur (as ointed aufi i our Jnc 4t} mecting).
I recall in my phone CUIIVCI5i1ti10115 ►rith fi•. l.eary (aftoi• talhin to t}c
City 1lttorney), tliat if t1cy did Iease te site for trtick lesing purposes,
tht thcy do it as a tempoxary mcsure, and put tlie land tck an ther m;rket
as soan ns possible.
