8.370 <br />ZONING CODE <br />8. Other Products. If service stations sell products other <br />than gas, oil, and other petroleum products, auto parts and <br />accessories, or sales from minor vending machine products, <br />then all other retail sales shall be conducted only in <br />compliance with all requirements and conditions for sales <br />in B-3 Districts. <br />9. Regulations by City Council. All conditions pertaining to a <br />specific site are subject to regulation by the Council �aith <br />or without recommendations by the Planning Commission when <br />the Council finds that the general welfare and public <br />betterment can be served by modifying conditions. <br />8.370. Nonmotorized Pathways Required. <br />On all properties which are on the City's official, nonmotorized <br />pathway system established by resolution of the Council, and on <br />all tax exempt property and B-1 through B-4 and shopping center <br />zoned properties, regardless of whether or not they are on the <br />official pathway system, where there is new buildinq <br />construction or renovation where the renovation value is fifty <br />percent (50 percent) or more of the prerenovation value of the <br />structure, nonmotorized pathways shall be constructed by the <br />property owner in public ri�ght-of-way, at a place prescribed by <br />the Public Works Director. Excepted from this requirement are <br />non-tax exempt R-1 and R-2 properties. <br />In lieu of c:onstruction of a nonmotorized pathway described <br />herein, the property owner may pay to the City an amoun� equal <br />to the cost of the nonmotorized pathway to satisfy the <br />obligations of this section. Said paym�ent shall be used by the <br />City to further maintenance and construction of the nonmotorized <br />pathway system within the City. <br />A proper�y owner seeking a variance from the requirement of this <br />section may ap�ply for such variance pursuant to the minor <br />variance procedures of �ection 12.055. <br />8.380. Purpose. <br />'Phe purpose of the Retail Office S�rvice District is to provide <br />for a limited mixture of land uses, mad� mutually compatible <br />through co�trols and high quality standards; to facilitate mo�e <br />intensive and higher valueci development and redevelopment of <br />areas convenient to the MetropoTi�an market area. This district <br />shall allow opportunities to integrate high quality office <br />structures, hotels, r�staurants, r�etail uses, and selected <br />office service and quality manufacturing uses, providing the <br />c�pportunity to benefit from excellent v�.sibility from major <br />arterial routes in conjunction with major local thoroughfares. <br />54 <br />� <br />� <br />
