In r�vie�aing the files, I found a letter from Mr. Bell stating that �he use could be cons'idered a machinery sales which is permitted in a�-3 if �rc�per special use pe�mits are obtained. I could find no r�cord of special use permits being issued on the site. This use has apparently been on the sit� since approximately 1952w The second question that I have relates to the fact that one of the lots utilized for outside storage is in fact zoned R-1 sia�gl� family resid�ntialo There is also an unimproved public alley easement rur�ning th�cough th� property w%ich is �.lso being utilized for outside storage. In March of 1966, Rosevil:le apparently approved vacation of the alley th�ough that �ntire block subject to retaining an easement over, undeY, and across said alley right-of-way for storm sewer, sanitary sewer, utility �nains, etc. The City, however, required that all�the owners of abutting prop�rties should sign the easement before the alley could be vacated. Apparent�y, all of the signatures w�re never obta�ned and the alley vacation never was �i�al�zed. In 1968, Mr. Zeece attempted to rezone the residentia? lot to B-3 but even�tually withdrew his applicati�n. According to a letter from an attorney re�r�sent�.ng Mr. Zeece at �he time, Mr. Zeece had apparently been fined for t�e business use of the residential lot. In a nut shell, there appears to be several ordinance violations on th� site. We have received numerous neighborhood complain�ts about �he sit�, we have a use that predates the City°s zoning �rdinance, and we have a property owner in apparent financial troubles who cannot financially afford to bring the site in� compliance.
