The first <br />question T have, is this a permitted use in td�at district? In <br />r�vie�aing the files, I found a letter from Mr. Bell stating that <br />�he use could be cons'idered a machinery sales which is permitted <br />in a�-3 if �rc�per special use pe�mits are obtained. I could <br />find no r�cord of special use permits being issued on the site. <br />This use has apparently been on the sit� since approximately <br />1952w <br />The second question that I have relates to the fact that one of <br />the lots utilized for outside storage is in fact zoned R-1 <br />sia�gl� family resid�ntialo There is also an unimproved public <br />alley easement rur�ning th�cough th� property w%ich is �.lso being <br />utilized for outside storage. In March of 1966, Rosevil:le <br />apparently approved vacation of the alley th�ough that �ntire <br />block subject to retaining an easement over, undeY, and across <br />said alley right-of-way for storm sewer, sanitary sewer, utility <br />�nains, etc. The City, however, required that all�the owners of <br />abutting prop�rties should sign the easement before the alley <br />could be vacated. Apparent�y, all of the signatures w�re never <br />obta�ned and the alley vacation never was �i�al�zed. In 1968, <br />Mr. Zeece attempted to rezone the residentia? lot to B-3 but <br />even�tually withdrew his applicati�n. According to a letter from <br />an attorney re�r�sent�.ng Mr. Zeece at �he time, Mr. Zeece had <br />apparently been fined for t�e business use of the residential <br />lot. <br />In a nut shell, there appears to be several ordinance violations <br />on th� site.
