DAUBNEY
ATTORNEYS AND COUNSELORS AT LAW
700 ANDMARK TOWERS
345 ST. PETER STREET
ST. PAUI., MINNESOTA 55102
Mr. Robert C. Bell
ROSEVILLE CITY ATTORNEY
2780 North Snelling Avenue, Suite 327
Roseville, MN 55113
RE: Roseville and A-Plus Industries
Your File No: 1011.65
My File No: 10.035
Dear Mr. Bell:
( 6121 224•4345
•ALSO ADMTTED IN WISCONSIN
In our telephone conversation of Tuesday, December 26, 1989, I
advised you that as soon as I receive a copy of our report as to
the alleged noise and vibration problems of A Plus Industries I
would furnish you with the same. On this date, December 27, 1g89,
I did in fact receive a copy of a letter addressed to Mr. Williams
by a person we believe to be an expert in this field, Mr. Alfonso E.
Perez, of Illbruck, Inc.. I am enclosing photocopy of that
letter together with the zesume' covering Mr. Perez's academic and
professional background. You will note that Mr. Perez"s peculiaraly
qualified in the noise pollution field having acted as Chief of
the Noise Pollution Control section of the Minnesota Pollution
Agency from 1973 to 1981.
The last paragraph in Mr. Perez's letter indicates that A P1us
Industries is happy to meet with the proper officials of the City
of Roseville and the appropriate technical experts to establish
:easonable criteria for A Plus to take whatever steps are reasonably
necessary to reduce any noise or vibration facors that adversely
impact the adjacent residential property.
The A Plus Tndustries site at 1430 West County Road C has had an
industrial usage and classification, even going back to the old
toe Township days when zoning was handled through RamsPy County.
A Plus wants to be a good neighbor and a good corporate citizen of
Roseville, but the adjacent residences must recognize that an
industrial businss was in operation at this sie b:fore their
houses were built, and it is unrealistic to assumP that any
industrial operatian is not going to produc some noise and
industrial activity.
