DraftSubdivisionOrdinanceΑAttachmentA <br />shallbereviewedinapublichearingbeforethePlanningCommissionandacted <br />uponbytheCityCouncilaccordingtotheprocesssetforthinChapter108ofthis <br />Code,exceptthatthetimeallowedforCityCouncilactionshallconformtoMinn. <br />Stat.§462.358subd.3b.Ifaproposedpreliminaryplatisdenied,anapplicationfor <br />substantiallythesameplatofthesamepropertyshallnotbeacceptedwithin1year <br />ofthedateofthedenial. <br />c.Validation:Apreliminaryplatapprovalshallbevalidatedbytheapplicantthrough <br />thesubmissionofanapplicationforfinalplatapprovalwithin1ye <br />arofthedateof <br />theapproval.Notwithstandingthistimelimitation,theCityCouncilmayapprove <br />extensionsofthetimeallowedforvalidationofthepreliminaryplatapprovalif <br />requestedinwritingbytheapplicant;extensionrequestsshallbesubmittedtothe <br />CommunityDevelopmentDepartmentandshallidentifythereason(s)whythe <br />extensionisnecessaryalongwithananticipatedtimelineforvalidation. <br />d.Expiration:Apreliminaryplatapprovalshallautomaticallyexpireiftheapprovalis <br />notvalidatedpursuanttoSubsectionc. <br />3.FinalPlat:RelationshiptoPreliminaryPlat:Afinalplatshallcontaintheinformation <br />requiredforrecordingpurposeswhilethepreliminaryplatprovidesmoredetailed <br />information.Thefinalplatshallconformtothepreliminaryplatexceptincaseswhere <br />theCityCouncilrequireschanges. <br />a.Application:Pursuanttoapprovalofapreliminaryplat,theownerofpropertyfor <br />whichafinalplatisproposedshallfileanapplicationforapprovalofthefinalplatby <br />payingthefeesetforthinChapter314ofthisCodeandsubmittingacompleted <br />applicationformandsupportingdocumentsassetforthontheapplicationform. <br />Completeapplicationsshallbeadministrativelyreviewedforconformancewiththe <br />preliminaryplatandincorporationofallchangesormodificationsrequiredbythe <br />CityCouncil,andacteduponbytheCityCouncilaccordingtoMinn.Stat.§462.358 <br />subd.3b. <br />2.RequiredChangesIncorporated:Thefinalplatshallhaveincorporated;inallotherrespectsit <br />shallconformtothepreliminaryplat.Itmayconstituteonlythatportionoftheapproved <br />preliminaryplatwhichthesubdividerproposestorecordanddevelopatthetime,providedthat <br />suchportionconformswithalltherequirementsofthisTitle.(1990Code;1995Code)(Ord. <br />1296,10202003) <br />G.ApprovalandRecording:.TheCityCouncilshallactuponafinalplatapplicationwithin120 <br />daysofthesubmissionofacompletedapplication.Therefusaltoapprovetheplatshallbeset <br />forthintheproceedingsoftheCityCouncilandreportedtothepersonorpersonsapplyingfor <br />suchapproval.Ifthefinalplatisapproved,thesubdividershallrecordsaidplatwiththeCounty <br />Recorderwithinoneyearafterthedateofapprovalandpriortotheissuanceofanybuilding <br /> <br />
